Regulamin konkursu "Jack Daniel’s Rocks”

§ 1 

Postanowienia ogólne

  1. Niniejszy regulamin (zwany dalej: „Regulaminem”), określa zasady, zakres
    i warunki uczestnictwa w konkursie organizowanym przez Organizatora
    (zwany dalej: „Konkursem”).

  2. Organizatorem Konkursu jest Grupa Freundschaft sp. z o.o. z siedzibą w Warszawie (00-511), przy ul. Nowogrodzka 21, wpisana do rejestru przedsiębiorców Krajowego Rejestru Sądowego prowadzonego przez Sąd Rejonowy dla m. st. Warszawy w Warszawie, XIII Wydział Gospodarczy Krajowego Rejestru Sądowego, pod numerem KRS 0000280647; NIP: 5213438349, REGON: 140767291 (zwany dalej: „Organizatorem”).

  3. Fundatorem nagród w Konkursie jest Brown-Forman Polska sp. z o.o. z siedzibą w Warszawie (02-676), przy ul. Postępu 21D, wpisana do rejestru przedsiębiorców Krajowego Rejestru Sądowego prowadzonego przez Sąd Rejonowy dla m. st. Warszawy, XII Wydział Gospodarczy Krajowego Rejestru Sądowego, pod numerem KRS: 00000055791, NIP: 526-00-13-887 REGON 010325438 (zwany dalej: „Fundatorem”).

  4. Konkurs będzie przeprowadzony na terytorium Rzeczypospolitej Polskiej (z zastrzeżeniem transgranicznego dostępu do Internetu) od dnia 01.09.2024 r. od godz. 16:00 do dnia 31.12.2024 r. do godz. 23:59 (zwany dalej: „Czasem Trwania Konkursu”) za pomocą zgłoszenia na stronie internetowej https://www.jackdaniels.com/pl-pl/konkurs

  5. Konkurs podzielony jest na 3 Etapy, w następujących terminach:

    1. Etap I- 1 września - 31 października

    2. Etap II - 1 listopada - 30 listopada

    3. Etap III – 1 grudnia - 31 grudnia

  6. Celem Konkursu jest wyłonienie najbardziej kreatywnych odpowiedzi na pytanie: „Wymień 7 rzeczy, które spakujesz ze sobą do USA i uzasadnij, dlaczego właśnie te.” (zwane dalej: „Zadaniem konkursowym”).

  7. Uczestnik nie może przenosić na osoby trzecie uczestnictwa w Konkursie, praw i obowiązków z nim związanych, w tym także prawa do żądania wydania przyznanej nagrody.

  8. Udział w Konkursie i podanie związanych z udziałem danych jest całkowicie dobrowolne, a także oznacza, że Uczestnik zapoznał się z Regulaminem Konkursu i w pełni go akceptuje.

  9. Organizator oświadcza, że Konkurs nie jest loterią fantową, zakładem wzajemnym, loterią promocyjną, których wynik zależy od przypadku, ani żadną inną grą losową przewidzianą w ustawie z dnia z dnia 19 listopada 2009 r. o grach hazardowych (Dz. U. z 2022 r. poz. 888 z późn. zm.).

  10. Ze względu na swój niepubliczny charakter, Konkurs nie stanowi reklamy ani promocji w rozumieniu przepisów ustawy z dnia 26 października 1982 r. o wychowaniu w trzeźwości i przeciwdziałaniu alkoholizmowi (Dz. U. z 2021 r. poz. 1119 z późn. zm.). Celem Konkursu jest nagradzanie osób, które najlepiej wykonały określone w ramach Konkursu zadanie konkursowe opisane w § 1 ust. 5 Regulaminu („Zgłoszenie Konkursowe”), na zasadach i warunkach określonych w niniejszym Regulaminie.


§ 2 

Zasady uczestnictwa w Konkursie

  1. W Konkursie mogą brać udział wyłącznie osoby fizyczne, które ukończyły 21 lat i posiadają pełną zdolność do czynności prawnych oraz mające miejsce zamieszkania na terenie Rzeczypospolitej Polskiej.

  2. W Konkursie nie mogą brać udziału pracownicy i współpracownicy Organizatora oraz Fundatora. Współpracownikami w rozumieniu Regulaminu są wszystkie osoby współpracujące z Organizatorem lub Fundatorem na podstawie umów cywilnoprawnych. W Konkursie nie mogą również brać udziału członkowie rodzin tych osób. Przez członków rodzin rozumie się: wstępnych, zstępnych, rodzeństwo, małżonków, rodziców małżonków, osób pozostających w stosunku przysposobienia, a także osób pozostających we wspólnym pożyciu.

  3. Organizator jest uprawniony do weryfikacji spełnienia warunków uczestnictwa w Konkursie, jeśli zachodzi uzasadnione podejrzenie, że dany Uczestnik działa sprzecznie z niniejszym Regulaminem. Organizator jest uprawniony do wykluczenia Uczestnika z udziału w Konkursie i odmowy przyznania mu nagrody, jeśli nie spełnia warunków uczestnictwa w Konkursie określonych w niniejszym Regulaminie lub też w przypadku powzięcia uzasadnionych podejrzeń, iż fotografia lub tekst zamieszczone przez Uczestnika w wykonaniu Zadania Konkursowego naruszają prawa osób trzecich lub też naruszają postanowienia ust. 13 poniżej.

  4. Aby wziąć udział w Konkursie i zawalczyć o Nagrody należy:

    1. w Czasie Trwania Konkursu kupić dowolną butelkę Jack Daniel’s;

    2. na stronie internetowej http://www.jackdaniels.com/pl-pl/konkurs udzielić odpowiedzi na pytanie: „Wymień 7 rzeczy, które spakujesz ze sobą do USA i uzasadnij, dlaczego właśnie te.”

    3. dodać zdjęcie/skan paragonu z którego będzie wynikać data oraz zakup dowolnej butelki Jack Daniel’s (zwane dalej: „Zgłoszeniem konkursowym”);

    4. podać swoje dane osobowe oraz zaakceptować Regulamin.

  5. Uczestnik poprzez dokonanie Zgłoszenia konkursowego gwarantuje, że posiada pełne prawa autorskie do stworzonej wypowiedzi (zgodnie z ustawą o prawie autorskim i prawach pokrewnych).

  6. W czasie trwania Konkursu, określonym w § 1 ust. 4 niniejszego Regulaminu, Uczestnik może przesłać wyłącznie jedno Zgłoszenie konkursowe w danym Etapie (łącznie nie więcej niż 3 zgłoszenia w trakcie trwania Konkursu). Aby zgłoszenie było skutecznie zgłoszone w każdym Etapie, zakup butelki Jack Daniel’s zgłoszonej do Konkursu, powinien być dokonany w czasie trwania danego Etapu. Zakazane jest korzystanie przez jedną osobę z wielu kont e-mailowych oraz rejestracji więcej niż jeden raz jednego paragonu. W przypadku powstania uzasadnionego podejrzenia o korzystaniu przez Uczestnika z różnych kont e-mail, wszelkie zgłoszenia takiej osoby zostaną usunięte i nie będą brały udziału w Konkursie.

  7. Uczestnik może w każdej chwili zrezygnować z udziału w Konkursie, poprzez poinformowanie o tym fakcie Organizatora.

  8. Uczestnik, z chwilą dodania Zgłoszenia konkursowego udziela Organizatorowi nieodpłatnej, przenoszalnej, lecz niewyłącznej licencji do korzystania z przedmiotów praw własności intelektualnej zawartych w danym Zgłoszeniu Konkursowym (niezależnie od otrzymania przez Uczestnika nagrody), w szczególności z utworów, bez ograniczeń terytorialnych, czasowych lub ilościowych, z prawem do udzielania sublicencji, na następujących polach eksploatacji:

    1. utrwalenie i zwielokrotnienie dowolną techniką w tym w szczególności techniką drukarską;

    2. wprowadzenie do obrotu;

    3. wykorzystanie całości i pojedynczych elementów dla potrzeb stworzenia dowolnych materiałów reklamowych (przykładowo reklamy prasowe, ulotki, plakaty o dowolnych rozmiarach, materiały okolicznościowe) oraz korzystanie z nich w ramach materiałów reklamowych, poprzez ich utrwalanie i zwielokrotnianie technikami opisanymi w punkcie a. powyżej, oraz wprowadzenie do obrotu, rozpowszechnianie, najem, użyczenie, a także publiczne udostępnianie w taki sposób, aby każdy mógł mieć do nich dostęp w miejscu i w czasie przez siebie wybranym;

    4. rozpowszechnianie i udostępnianie w sieci Internet poprzez wprowadzenie do pamięci komputera bez względu na ilość nadań, emisji, wytworzonych egzemplarzy;

    5. rozpowszechnianie w jakikolwiek inny sposób w całości lub części, nadawanie za pomocą wizji, fonii przewodowej i bezprzewodowej przez stacje naziemne, za pośrednictwem satelity, wystawienie, wyświetlenie, publiczne odtworzenie, publiczne wykonanie, nadawanie w sposób równoczesny i integralny z inną organizacją lub podmiotem radiowym lub telewizyjnym, publiczne udostępnienie utworu w taki sposób, aby każdy mógł mieć do niego dostęp w miejscu i w czasie przez siebie wybranym;

    6. najem, dzierżawa, zarejestrowanie utworu jako znaku towarowego, wzoru użytkowego lub przemysłowego.

  9. Na mocy licencji określonej powyżej, utwór Uczestnika zawarty w Zgłoszeniu konkursowym może być wykorzystany w dowolny sposób, przetworzony, rozpowszechniony w całości lub w części, w połączeniu z innymi dziełami, może zostać zmieniony, opracowany, w szczególności w celu promocji i reklamy, w tym formie plakatów, folderów, w tym reklam audiowizualnych. Uczestnik wyraża zgodę na korzystanie i rozporządzanie opracowaniem jego utworu (zgoda na wykonywanie praw zależnych), z prawem do dalszego upoważnienia do wykonywania praw zależnych.

  10. Organizator upoważniony jest do wykorzystania utworu w sposób anonimowy.

  11. Zgłoszenie konkursowe powinno być zgodne z prawem oraz ogólnie przyjętymi normami obyczajowymi, w tym: nie może zawierać treści powszechnie uznanych za obraźliwe, nie może godzić w uczucia religijne i polityczne osób trzecich czy naruszać praw osób trzecich.

  12. Uczestnik na życzenie Organizatora zawrze z nim w formie pisemnej odrębną umowę licencji lub przeniesienia autorskich praw majątkowych do utworów zawartych w danym Zgłoszeniu konkursowym.

  13. Niedopuszczalne jest zgłaszanie do Konkursu Zgłoszenia konkursowego, które:

    1. Narusza prawa osób trzecich, w szczególności prawa autorskie i pokrewne, dobra osobiste oraz prawa własności intelektualnej;

    2. Zawiera treści niezgodne z prawem lub dobrymi obyczajami, w szczególności obraźliwe, wulgarne, pornograficzne, propagujące przemoc, nienawiść rasową lub religijną;

    3. Zawiera przekazy reklamowe;

    4. Zawiera odnośniki do innych stron internetowych;

    5. Zostały stworzone przy udziale sztucznej inteligencji.

  14. Uczestnik ponosi odpowiedzialność za powstałe z tytułu rozpowszechnienia przez Organizatora Zgłoszenia konkursowego szkody, tym samym zwalniając Organizatora z ewentualnych roszczeń.

§ 3

Nagrody w Konkursie

  1. Nagrodami w konkursie są (łącznie dalej zwane: „Nagrodami”):

    1. Trzy dwuosobowe wyjazdy do Tennessee wraz ze zwiedzaniem destylarnii Jacka Daniel’s (dalej: “Nagroda Główna”). Każdy wyjazd o wartości 40 372,86 zł (sł. czterdzieści tysięcy trzysta siedemdziesiąt dwa złote i osiemdziesiąt sześć groszy)

    2. 7 gramofonów Jack Daniels o wartości 1 982,96 zł (sł. tysiąc dziewięćset osiemdziesiąt dwa złote i dziewięćdziesiąt sześć groszy) każdy.

    3. 77 butelek Jack Daniel’s Bonded, każda o wartości 184,99 zł (sł. sto osiemdziesiąt cztery złote dziewięćdziesiąt dziewięć groszy)

  2. Nagroda Główna obejmuje loty:

    1. Warsaw (WAW) – Amsterdam (AMS) 12/04/2025 06:00 - 08:00 (KL1310)

    2. Amsterdam (AMS) – Atlanta (ATL) 12/04/2025 10:30 - 14:00 (DL073)

    3. Atlanta (ATL) - Memphis (MEM) 12/04/2025 17:23 - 17:46 (DL2939)

    4. Nashville (BNA) - Atlanta (ATL) 16/04/2025 12:14 - 14:23 (DL1680)

    5. Atlanta (ATL) - Paris (CDG) 16/04/2025 16:30 - 07:00 +1 (AF031)

    6. Paris (CDG) – Warsaw (WAW) 17/04/2025 08:40 - 10:55 (AF1146),

    7. oraz transfery do i z lotniska w Tennessee, a także wszystkie podróże podczas całej podróży, 4 noclegi w 3 gwiazdkowym hotelu, w pokoju dwuosobowym oraz wyżywieniem oraz biletami wstępu do destylarnii Jack Daniel’. Zwycięzca oraz jego gość muszą posiadać ważny paszport oraz wizę do Stanów Zjednoczonych lub zezwolenie na podróż (ESTA), chyba że są posiadaczami zielonej karty. Zwycięzca oraz jego gość muszą spełniać wymagania imigracyjne (oraz wymagania dotyczące Covid - 19) dotyczące wjazdu do Stanów Zjednoczonych. Wszelkie kwestie administracyjne związane z podróżą spoczywają na Zwycięzcy oraz jego gościu. Wszelkie dodatkowe wydatki, w tym wydatki dodatkowe, podróż do i z lotniska wylotowego oraz zapewnienie ubezpieczenia są obowiązkiem Zwycięzcy.

  3. Każdy Uczestnik może wygrać tylko jedną Nagrodę danego typu w Konkursie (tj. jeśli w Etapie I Uczestnik wygrał wyjazd do Tennessee, to w kolejnym etapie może wygrać wyłącznie gramofon lub butelkę Jack Daniel’s Bonded (o ile złożył kolejne Zgłoszenie Konkursowe).

  4. Zwycięzców Konkursu (dalej zwanych: „Laureatami”) wybierze Komisja Konkursowa wybrana przez Organizatora (dalej zwana: „Komisją Konkursową”). W skład Komisji Konkursowej wchodzą trzy osoby wybrane przez Organizatora.

  5. Wyłączone jest prawo żądania przez Laureata wypłaty równowartości nagrody w gotówce bądź prawo jej zamiany na inną nagrodę.

  6. Laureat nagrody o której mowa w § 3 ust. 1 lit. a. zostanie poinformowany o terminie wyjazdu co najmniej na 30 dni przed wyjazdem. Organizator planuje, że wyjazd odbędzie się w kwietniu 2025 r.

§ 4

Zasady przyznawania Nagród w Konkursie

  1. Spośród wszystkich Zgłoszeń Konkursowych Komisja Konkursowa powołana przez Organizatora wybierze najbardziej kreatywne Zgłoszenia konkursowe, które zostaną nagrodzone Nagrodami w ramach niniejszego Konkursu, zgodnie z zasadami opisanymi w § 3 Regulaminu. Przy wyborze Laureatów Komisja Konkursowa kierować się będzie swoim własnym uznaniem, biorąc pod uwagę oryginalność oraz kreatywność przy wykonaniu Zadania konkursowego.

  2. Wybór nagród będzie odbywał się po zakończeniu każdego Etapu. Po Etapie I Organizator wybierze Laureatów którzy otrzymają:
    a. 1 Nagrodę Główną,
    b. 3 gramofony oraz
    c. 25 butelek Jack Daniel’s Bonded.
    Po Etapie II i III Organizator wybierze Laureatów którzy otrzymają:
    a. 1 Nagrodę Główną;
    b. 2 gramofony oraz
    c. 26 butelek Jack Daniel’s Bonded
    Wybór Laureatów będzie następował ze wszystkich zgłoszeń, które wpłynęły do dnia wyboru.

  3. Laureaci Konkursu zostaną powiadomieni o wygranej za pośrednictwem wiadomości e-mail podany w trakcie rejestracji, nie później niż w terminie 10 dni od dnia zakończenia danego Etapu

  4. Z prac Komisji Konkursowej zostaną sporządzone protokoły.

  5. Do wartości każdej Nagrody zostanie dodana dodatkowa nagroda pieniężna w wysokości odpowiadającej zryczałtowanemu podatkowi dochodowemu od osób fizycznych z tytułu wygranej w Konkursie w kwocie stanowiącej 11,11% wartości Nagrody. Laureat zgadza się, że kwota dodatkowej nagrody pieniężnej nie podlega wypłacie na jego rzecz, lecz przeznaczona jest na zapłatę podatku należnego z tytułu wygranej Nagrody w Konkursie.

  6. Organizator jako płatnik zryczałtowanego podatku dochodowego od osób fizycznych, przed wydaniem zdobywcy Nagrody obliczy, pobierze i odprowadzi do właściwego Urzędu Skarbowego zryczałtowany podatek dochodowy należny z tytułu wygranej. Zdobywca Nagrody jest zobowiązany przekazać Organizatorowi wszelkie dane niezbędne do wypełnienia wyżej wskazanych obowiązków.

  7. Organizator nie ponosi odpowiedzialności w przypadku niemożności powiadomienia Laureata o wygranej z powodu podania przez Uczestnika błędnego adresu e-mail, zmiany adresu e-mail w czasie trwania Konkursu.

§ 5

Zasady wydawania Nagród w Konkursie

  1. O fakcie wygranej oraz sposobie wydania nagrody, Organizator poinformuje Laureatów za pośrednictwem wiadomości e-mail, na adres wskazany podczas rejestracji.

  2. Organizator w wiadomości, o której mowa powyżej, zażąda od Laureatów podania danych niezbędnych do wydania nagrody, takich jak:

    1. imię i nazwisko Uczestnika;

    2. adres, na który ma zostać wysłana Nagroda (jeśli jest inny niż adres zamieszkania);

    3. danych wymaganych przepisami prawa podatkowego na cele sprawozdawczości podatkowej związanej z realizacją Konkursu, tj. adres zamieszkania, PESEL, właściwy urząd skarbowy;

    4. informacji czy Laureat Nagrody Głównej oraz jego osoba towarzysząca mają ukończone 21 lat

  3. Laureat zobowiązany jest przesłać dane, o których mowa w pkt 2 w terminie 3 dni od otrzymania wiadomości od Organizatora. Niewysłanie przez Laureata danych, o których mowa w ust. 2 powyżej, w terminie wskazanym w zdaniu pierwszym oznacza utratę prawa Uczestnika do Nagrody.

  4. W przypadku braku możliwości powiadomienia Laureata o wygraniu Nagrody, braku kontaktu ze strony Laureata we wskazanym terminie, lub w przypadku, gdy Laureat oraz jego osoba towarzysząca mają mniej niż 21 lat, lub w przypadku niepodania wymaganych danych przez Zwycięzcę Konkursu w terminie 3 dni od dnia powiadomienia Laureata o wygranej, bądź podania nieprawdziwych danych, nagroda nie zostanie przyznana, a Laureata traci prawo do nagrody. W takim przypadku Organizator powtarzając procedurę powiadomienia o wygranej skontaktuje się z kolejną osobą, która zajęła kolejne, niższe miejsce w Konkursie bądź zdecyduje o przepadku Nagrody.

  5. Nagrody (z wyłączeniem Nagrody Głównej) zostaną wysłane kurierem przez Organizatora na adres wskazany przez Uczestnika w wiadomości, o której mowa w ust. 3 powyżej.

  6. Organizator nie przewiduje informowania Uczestników, którzy nie zostali zwycięzcami,
    o ich indywidualnych wynikach w Konkursie.

  7. Podmiotem wydającym Nagrody w Konkursie jest Organizator.

  8. Laureaci Nagrody Głównej oraz ich osoby towarzyszące mogą być poproszone o wyrażenie zgody na nieodpłatne wykorzystanie ich wizerunku, w celu stworzenia materiału filmowego z wyjazdu, który Organizator wykorzysta w celach promocyjnych. Zgoda jest dobrowolna i nie stanowi warunku otrzymania nagrody.

  9. Laureat Nagrody Głównej oraz osoba towarzysząca muszą w chwili wyjazdu mieć ukończone 21 lat.

§ 6

Postępowanie reklamacyjne

  1. Reklamacje dotyczące Konkursu należy składać pisemnie na adres pocztowy: Grupa Freundschaft Sp. z o.o. ul. Nowogrodzka 21, 00-511 Warszawa z dopiskiem "Jack Daniel’s Rocks” lub ustnie w siedzibie Organizatora lub za pośrednictwem poczty elektronicznej, pod adresem [email protected]

  2. Reklamacje będą rozstrzygane w terminie 14 dni od daty otrzymania danej reklamacji przez Komisję Konkursową powołaną przez Organizatora. Decyzja Komisji Konkursowej, co do zgłoszonej reklamacji jest ostateczna. Od decyzji Komisji Konkursowej nie przysługuje odwołanie do innych organów Organizatora. Pozostaje to bez wpływu na prawo Uczestnika do dochodzenia przysługujących mu roszczeń w postępowaniu sądowym.

  3. Reklamacje można wnosić w czasie Trwania Konkursu oraz nie później niż w terminie 1 miesiąca od daty rozstrzygnięcia Konkursu. Po upływie tego terminu reklamacje nie będą uwzględniane.

  4. Prawidłowo złożona reklamacja powinna zawierać: imię, nazwisko, dokładny adres Uczestnika oraz powody reklamacji.

  5. Uczestnik zostanie powiadomiony o rozpatrzeniu reklamacji pisemnie na adres podany w reklamacji.

§ 7

Dane osobowe

  1. Biorąc udział w Konkursie, każdy zwycięzca przyjmuje do wiadomości i wyraża zgodę na wykorzystanie jego nazwiska w rozsądnej przyszłej reklamie do celów marketingowych lub promocyjnych bez dodatkowego wynagrodzenia.

  2. O ile Uczestnik nie wyraził chęci otrzymywania w przyszłości korespondencji od Fundatora, jego dane osobowe będą przechowywane wyłącznie w celu obsługi Konkursu i nie będą przechowywane po zakończeniu losowania nagród. zakończyła się i każdy zwycięzca otrzymał swoją nagrodę.

  3. Uczestnicy przyjmują do wiadomości, że Brown-Forman Corporation (BROWN-FORMAN), spółka-matka Założyciela, oraz inne spółki wchodzące w skład grupy BROWN-FORMAN (szczegóły dostępne na życzenie) lub pracownicy, agenci, partnerzy lub licencjobiorcy BROWN-FORMAN , będzie przetwarzać jego dane osobowe, zgodnie z polityką prywatności BROWN-FORMAN https://legal.brown-forman.com/privacy-policy/polish, w uzasadnionych celach biznesowych, takich jak świadczenie im spersonalizowanych usług i treści, w celu analizować i rozważać sposoby ulepszenia naszych usług i produktów oraz odpowiadać na ich prośby. Dane osobowe uczestników mogą być przekazywane do dowolnego kraju, w którym spółki z grupy BROWN-FORMAN lub nasi usługodawcy posiadają obiekty, a dane osobowe będą przechowywane w zakresie dozwolonym przez obowiązujące prawo. Jeżeli w przyszłości uczestnicy nie chcą otrzymywać dalszych wiadomości od grupy BROWN-FORMAN i woleliby zostać usunięci z jej bazy danych, lub jeśli chcą poprawić swoje dane lub zmienić sposób otrzymywania od nas wiadomości, prosimy napisać na adres : [email protected]

§ 8

Świadczenie usług drogą elektroniczną

  1. W ramach Konkursu Organizator świadczy nieodpłatnie na rzecz Uczestników, na zasadach opisanych w niniejszym Regulaminie, usługi drogą elektroniczną w zakresie niezbędnym do realizacji Konkursu.

  2. Przez usługi świadczone drogą elektroniczną na potrzeby Konkursu należy rozumieć takie usługi jak:

    1. udostępnienie Regulaminu;

    2. umożliwienie zapoznania się z Zadaniem Konkursowym;

    3. umożliwienie wzięcia udziału w Konkursie.

  3. Umowa o świadczenie usług drogą elektroniczną zostaje zawarta z chwilą, gdy Uczestnik rozpocznie korzystanie z usług objętych Regulaminem.

  4. Umowa o świadczenie usług drogą elektroniczną może być w każdej chwili rozwiązana przez Uczestnika poprzez rezygnację z uczestnictwa w Konkursie.

  5. Warunkiem technicznym niezbędnym do korzystania z usług świadczonych drogą elektroniczną jest posiadanie zainstalowanej przeglądarki internetowej np. Internet Explorer, Mozilla Firefox, Opera, Chrome, Safari.

  6. Organizator zastrzega, że korzystanie z usług objętych Regulaminem może wiązać się ze standardowym ryzykiem związanym z wykorzystaniem sieci Internet i rekomenduje Uczestnikom, przedsięwzięcie odpowiednich kroków w celu ich zminimalizowania.

  7. Organizator korzysta we własnym zakresie z zabezpieczeń systemowych i stałej pomocy informatycznej zapewniając bezpieczeństwo przesyłanych i odbieranych danych.

  8. Do reklamacji usług świadczonych drogą elektroniczną stosuje się odpowiednio postanowienia § 6 Regulaminu, przy czym termin na zgłoszenie reklamacji liczy się od momentu wystąpienia zdarzenia uzasadniającego złożenie reklamacji.

  9. W sprawach nieuregulowanych w niniejszym Regulaminie w zakresie świadczenia usług drogą elektroniczną zastosowanie mają powszechnie obowiązujące przepisy prawa, w tym w szczególności ustawa z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną (t.j. Dz. U. z 2020 r. poz. 344).

§ 9

Postanowienia końcowe

  1. Postanowienia niniejszego Regulaminu podlegają przepisom prawa polskiego. W sprawach nieuregulowanych niniejszym Regulaminem zastosowanie znajdować będą powszechnie obowiązujące przepisy, a w szczególności przepisy Kodeksu cywilnego.

  2. Organizator zastrzega sobie prawo zmiany postanowień niniejszego Regulaminu, jeżeli jest to uzasadnione celem Konkursu i nie wpłynie na pogorszenie warunków uczestnictwa w Konkursie.

  3. Zasady przeprowadzania Konkursów określa wyłącznie niniejszy Regulamin.

  4. Z wyjątkiem odpowiedzialności poniesionej przez Uczestnika, która nie może być ograniczona przez prawo, Organizator i Fundator nie ponoszą odpowiedzialności za jakiekolwiek obrażenia ciała, śmierć lub wydatki poniesione przez Uczestnika w związku z jego udziałem w niniejszym Regulaminie. Organizator i Fundator nie ponoszą również odpowiedzialności za szkody poniesione w związku z otrzymaniem Nagrody.

  5. W zakresie dozwolonym przez obowiązujące prawo Fundator oraz Organizator nie ponoszą odpowiedzialności z tytułu Regulaminu, w tym za szkody pośrednie wynikające z korzystania z Nagrody. Fundator oraz Organizator nie ponoszą również odpowiedzialności za straty lub szkody pośrednie, w tym za jakiekolwiek obrażenia lub szkody ciała.

  6. Regulamin został sporządzony w dwóch wersjach językowych: polskiej i angielskiej. W przypadku jakichkolwiek rozbieżności pomiędzy wersjami językowymi, rozstrzygające znaczenie ma wersja polska.

Regulations of the competition "Jack Daniel’s Rocks"

§ 1

General provisions

  1. These Regulations (hereinafter: "Regulations"), define the terms, scope
    and conditions of participation in the contest organized by the Organizer (
    hereinafter: "Contest").

  2. The Organizer of the Contest is Grupa Freundschaft sp. z o.o. with its registered office in Warsaw (00-511), Nowogrodzka 21, registered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the City of Warsaw in Warsaw, XIII Economic Department of the National Court Register, under KRS number 0000280647; NIP: 5213438349, REGON: 140767291 (hereinafter: "Organizer").

  3. Founder is Brown-Forman Polska sp. z o. o. with its headquarters in Warsaw (02-676), at 21D Postępu Street, registered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw, XII Economic Department of the National Court Register, under KRS number: 00000055791, NIP: 526-00-13-887 REGON 010325438 (hereinafter: "Founder").

  4. The Contest will be conducted on the territory of the Republic of Poland (subject to cross-border access to the Internet) from 01.09.2024 at 16::00 p.m. until 31.12.2024 at 11:59 p.m. (hereinafter referred to as the "Contest Duration") by filing on the website https://www.jackdaniels.com/pl-pl/konkurs

  5. The Competition is divided into 3 Stages, on the following dates:

    1. Stage I – Septemper 1- October 31

    2. Stage II – November 1 - November 30

    3. Stage III - December 1- December 31

  6. The purpose of the Contest is to select the most creative answer the question "List 7 things you will pack with you to the USA and explain why these.?" (hereinafter referred to as the "Contest Task").

  7. Participant may not transfer to third parties participation in the Contest, rights and obligations related to it, including the right to claim the awarded prize.

  8. Participation in the Contest and providing data related to participation is completely voluntary, and it means that the Participant has read the Contest Regulations and fully accepts them.

  9. The Organizer declares that the Contest is not a lottery, pari-mutuel betting, promotional lottery, the results of which depend on chance, or any other game of chance provided for in the Act of November 19, 2009 on gambling games (Journal of Laws of 2022, item 888, as amended).

  10. Due to its non-public nature, the Contest does not constitute advertising or promotion within the meaning of the provisions of the Act of October 26, 1982 on Upbringing in Sobriety and Counteracting Alcoholism (Journal of Laws of 2021, item 1119, as amended). The purpose of the Contest is to reward the persons who best performed the Contest task described in § 1 section 5 of the Regulations ("Contest Entry"), under the terms and conditions specified in these Regulations.

§ 2

Rules of participation in the Competition


  1. The Contest is open only to natural persons who are at least 21 years old and have full legal capacity and who reside in the Republic of Poland.

  2. Employees and collaborators of the Organizer and the Founder cannot participate in the Contest. Collaborators in the meaning of the Regulations are all persons cooperating with the Organizer or the Founder on the basis of civil law contracts. Also, family members of these persons cannot participate in the Contest. Family members are understood as: ascendants, descendants, siblings, spouses, parents of spouses, persons in an adoption relationship, as well as persons in cohabitation.

  3. The Organizer has the right to verify the fulfillment of the conditions of participation in the Contest, if there is a justified suspicion that a given Participant acts contrary to these Regulations. The Organizer has the right to exclude an Participant from the Contest and refuse to award him/her the prize if he/she does not meet the conditions of participation in the Contest specified in these Regulations, or in the case of a justified suspicion that the photo or text posted by the Participant in the performance of the Contest Task violates the rights of third parties, or violates the provisions of paragraph 13 below.

  4. In order to take part in the Contest and compete for Prizes, you must:

    1. Purchase any bottle of Jack Daniel’s during the Contest Period;

    2. Answer the question “List 7 things you will pack with you to the USA and explain why these” on the websitehttp://www.jackdaniels.com/pl-pl/konkurs 

    3. Add a photo/scan of the receipt showing the date and purchase of any bottle of Jack Daniel’s (hereinafter: "Contest Entry"); and

    4. submit your personal details and accept the terms and conditions of entry.

  5. By submitting a Contest Entry, the Participant guarantees that he/she owns full copyrights to the posted to the created statement (according to the Law on Copyright and Related Rights).

  6. A Participant may submit only one Contest Entry in a given Phase (no more than 3 entries in total during the Contest) during the Contest period specified in § 1.4 of these Rules. In order for an Entry to be successfully submitted in each Stage, the purchase of a bottle of Jack Daniel's entered in the Contest, should be made during the duration of a given Stage. It is forbidden for one person to use multiple e-mail accounts, and to register more than once a single receipt. In the event that a reasonable suspicion arises that an Entrant is using multiple email accounts, any entry by such person will be deleted and will not participate in the Contest.

  7. The Participant may withdraw from the Contest at any time by notifying the Organizer.

  8. The Participant, at the moment of adding an Entry to the Contest, grants the Organizer and Founder a free, transferable, but non-exclusive license to use the objects of intellectual property rights contained in a given Contest Entry (regardless of the Participant's receipt of the prize), in particular of the works without territorial, time or quantity limitations, with the right to grant sublicenses, in the following fields of exploitation:

    1. fixation and reproduction by any technique including, in particular, printing;

    2. placing on the market;

    3. The use of the whole and individual elements for the creation of any advertising materials (for example, press advertisements, leaflets, posters of any size, occasional materials) and the use of them as part of advertising materials, through their fixation and reproduction by techniques described in item a. above, and marketing, distribution, rental, lending, as well as making them available to the public in such a way that everyone can have access to them at a place and time of their own choosing;

    4. dissemination and sharing on the Internet by entering into computer memory regardless of the number of broadcasts, emissions, copies produced;

    5. dissemination in any other way in whole or in part, broadcasting by means of vision, wired and wireless sound by terrestrial stations, via satellite, exhibition, display, public performance, public reproduction, public performance, broadcasting in a simultaneous and integral manner with another organization or radio or television entity, making the work available to the public in such a way that everyone can have access to it at a place and time of their choosing;

    6. lease, rental, registration of a work as a trademark, utility model or industrial design.

  9. Under the license specified above, the Participant's work contained in the Contest Entry may be used in any way, processed, distributed in whole or in part, combined with other works, may be altered, developed, especially for promotion and advertising, including the form of posters, brochures, including audiovisual advertisements. The Participant agrees to use and dispose of the development of his work (permission to exercise subsidiary rights), with the right to further authorize the exercise of subsidiary rights.

  10. The Organizer is authorized to use the work anonymously.

  11. The Contest Entry should comply with the law and generally accepted moral norms, including: it must not contain content generally considered offensive, must not hurt the religious and political feelings of third parties or violate the rights of third parties.

  12. The Participant shall, at the request of the Organizer, enter into a separate written agreement with the Organizer for the license or transfer of copyrights to the works contained in a given Contest Entry.

  13. It is inadmissible to submit to the Competition a Competition Entry that:

    1. Violates the rights of third parties, in particular copyright and related rights, personal rights and intellectual property rights;

    2. Contains content that violates the law or good morals, in particular, offensive, vulgar, pornographic, promoting violence, racial or religious hatred;

    3. It contains advertising messages;

    4. Includes links to other websites.

    5. The were created with the help of artificial intelligence.

  14. The Participant shall be liable for damages arising from the Organizer's distribution of the Contest Entry, thereby releasing the Organizer and Founder from any claims.


§ 3

Prizes in the Contest

  1. The prizes in the contest are (collectively, the “Prizes”):

    1. Three two-person trips to Tennessee with a tour of Jack Daniel's distillery (hereinafter referred to as the “Grand Prize”). Each trip with a value of 40 372,86 PLN (word: forty thousand three hundred seventy two point eighty six PLN)

    2. 7 Jack Daniels turntables worth 1 982,96 PLN (one thousand nine hundred eighty two point ninety six PLC) each.

    3. 77 bottles of Jack Daniel's Bonded, each worth 184,99 PLN (one hundred eighty four point ninety nine PLN)

  2. The Grand Prize includes flights to and from:

    1. Warsaw (WAW) – Amsterdam (AMS) 12/04/2025 06:00 - 08:00 (KL1310)

    2. Amsterdam (AMS) – Atlanta (ATL) 12/04/2025 10:30 - 14:00 (DL073)

    3. Atlanta (ATL) - Memphis (MEM) 12/04/2025 17:23 - 17:46 (DL2939)

    4. Nashville (BNA) - Atlanta (ATL) 16/04/2025 12:14 - 14:23 (DL1680)

    7. transfers to and from the airport at Tennessee as well as all travel throughout the trip, 4 nights in 3 starts hotel based on two people sharing (double or twin room depending on availability) all meals, and admission tickets to the Jack Daniel's distillery The Winner and his/her guest must have a valid passport and a visa to the United States or an ESTA travel permit, unless they are green card holders. The Winner and his or her guest must meet immigration requirements (and Covid - 19 requirements) for entry into the United States. All administrative issues related to travel are the responsibility of the Winner and his/her guest. Any additional expenses, including incidental expenses, travel to and from the departure airport, and providing insurance are the responsibility of the Winner.

  3. Each Participant may only win one Prize of a given type in the Contest (i.e., if an Entrant won a trip to Tennessee in Stage 1, he/she may only win a turntable or a bottle of Jack Daniel's Bonded in the next stage (as long as he/she submitted a subsequent Contest Entry).

  4. The winners of the Contest (hereinafter: "Winners") will be selected by the Contest Commission selected by the Organizer (hereinafter: "Contest Commission"). The Contest Commission is composed of three persons selected by the Organizer.

  5. The Winners right to request payment of the equivalent of the Prize in cash or the right to exchange it for another prize is excluded.

  6. The Winner of the Prize referred to in § 3 par. 1 letter a. will be informed of the date of the trip at least 30 days before the trip. The Organizer plans that the trip will take place in April 2025.

§ 4

Rules for Awarding Prizes in the Contest

  1. From among all Contest Entries, the Contest Committee appointed by the Organizer will select the most creative Contest Entries, which will be awarded Prizes in this Contest, in accordance with the rules described in § 3 of the Regulations. In selecting the Winners of the Prizes, the Contest Committee will be guided by its own discretion, taking into account originality and creativity in the execution of the Contest Task.

  2. The selection of prizes will take place after each Stage. After Stage I, the Organizer will select the Winners who will receive:
    a. 1 Grand Prize,
    b. 3 gramophones, and
    c. 25 bottles of Jack Daniel's Bonded.
    After Stage II and Stage III, the Organizer will select the Winners who will receive:
    a. 1 Grand Prize;
    b. 2 turntables, and
    c. 26 bottles of Jack Daniel's Bonded
    Winners will be selected from all entries received by the selection date.

  3. Winners of the Contest will be notified of their winnings via email provided during registration, no later than 10 days from the date of completion of the round in question.

  4. Minutes of the work of the Competition Commission will be drawn up.

  5. An additional cash prize will be added to the value of each Prize in an amount equivalent to the lump sum personal income tax due for winning the Prize in the Contest in an amount equal to 11.11% of the value of the Prize. The Prize winner agrees that the amount of the additional cash prize shall not be paid to him/her, but shall be used to pay the tax due on the Prize won in the Contest.

  6. The Organizer, as the payer of the lump-sum personal income tax, shall calculate, collect and remit to the appropriate Tax Office the lump-sum income tax due for the Prize before releasing it to the Prize winner. The Prize winner is obliged to provide the Organizer with all data necessary to fulfill the aforementioned obligations.

  7. The Organizer shall not be liable in case of inability to notify the Winner of the prize due to the Participant's provision of an incorrect e-mail address, change of e-mail address during the Contest.

§ 5

Rules for issuing Prizes in the Contest

  1. The Organizer will inform the Winners about the fact of winning and how the prize will be disbursed via e-mail to the address indicated during registration.

  2. In the message mentioned above, the Organizer will request the Winners to provide the data necessary for the issuance of the prize, such as:

    1. Participant's name;

    2. The address to which the Prize is to be sent (if different from the address of residence);

    3. data required by the tax law for tax reporting purposes related to the execution of the Competition, i.e. address of residence, PESEL, relevant tax office.

    4. informacion on whether the Main Prize Laureate and their companion are over 21 years of age.

  3. The Winner is obliged to send the data referred to in item 2 within 3 days of receiving the message from the Organizer. Failure of the Winer to send the data referred to in paragraph 2 above within the time limit indicated in the first sentence shall mean the loss of the Participant's right to the Prize.

  4. In the event of failure to notify the Winner of winning the Prize or the event that the Winner and his/her companion are under 21 years of age failure of the Winner to contact the Organizer within the designated period of time, or in the event of failure of the Contest Winner to provide the required data within 3 days from the date of notifying the Winner of winning, or providing false data, the Prize will not be awarded, and the Winner will forfeit the right to the prize. In such a case, the Organizer, repeating the procedure of notification of winning, will contact the next person who took the next lower place in the Contest or decide to forfeit the Prize.

  5. Where relevant, the Prizes (excluding the Grand Prize) will be sent by courier by the Organizer to the address indicated by the Participant in the message referred to in paragraph 3 above.

  6. The Organizer does not expect to inform Participants who are not winners about their individual results in the Contest.

  7. The Organizer is the entity issuing the Prizes in the Contest.

  8. Winners of the Grand Prize and their accompanying persons may be asked to consent to the free use of their image, in order to create footage of the trip, which the Organizer will use for promotional purposes. The consent is voluntary and is not a condition for receiving the prize.

  9. The Winners and his/her accompanying person, must be over 21 years of age at the time of departure.

§ 6

Complaint procedure

  1. Complaints regarding the Contest should be submitted in writing to the postal address: Grupa Freundschaft Sp. z o.o. Nowogrodzka 21 Street, 00-511 Warsaw, with the annotation "JAck Daniel’s Rocks" verbally at the Organizer's office or via e-mail, at [email protected]

  2. Complaints will be resolved within 14 days from the date of receipt of a given complaint by the Contest Commission appointed by the Organizer. The decision of the Contest Commission as to the submitted complaint is final. The Contest Commission's decision cannot be appealed to other bodies of the Organizer. This does not affect the Entrant's right to pursue his claims in court proceedings.

  3. Complaints can be filed during the Contest Period and no later than
    1 month from the date of Contest settlement. After this deadline, complaints will not be considered.

  4. A properly submitted complaint should include: name, surname, exact address of the Participant and reasons for the complaint.

  5. The Participant will be notified of the processing of the complaint in writing to the address provided in the complaint.

§ 7

Personal information

  1. By participating in the Contest, each winner acknowledges and consents that his / her name may be used in reasonable future publicity for marketing or promotional purposes without additional compensation.

  2. Unless a Participant has indicated that he/she would like to receive communications from the Founder in the future, his/her personal data will only be held for the purpose of administering the Contest and will not be retained once the prize draw has been concluded and each winner has received their prize.

  3. Participants acknowledge that Brown-Forman Corporation (BROWN-FORMAN), parent company of the Founder, and other companies within the BROWN-FORMAN group (details of which are available on request) or BROWN-FORMAN's employees, agents, partners or licensees, will handle their personal information, in accordance with the BROWN-FORMAN privacy policy https://legal.brown-forman.com/privacy-policy/polish, for legitimate business purposes such as to provide them with personalised services and content, to analyse and consider ways of improving our services and products, and to respond to their requests. Partipcants personal information may be transferred to any country where BROWN-FORMAN group companies or our service providers have facilities and personal information will be retained as permitted by applicable law. If in the future entrants do not wish to receive further communications from the BROWN-FORMAN group and would prefer to be removed from its database, or if they wish to make corrections to their details or change how they receive communications from us, please write to: [email protected]

§ 8

Provision of services by electronic means

  1. As part of the Contest, the Organizer provides free of charge to the Participants, under the terms and conditions described in these Regulations, electronic services to the extent necessary for the execution of the Contest.

  2. Services provided electronically for the purposes of the Contest shall be understood as such services as:

    1. making the Regulations available;

    2. Allowing you to get acquainted with the Contest Task;

    3. Enabling participation in the Competition.

  3. The contract for the provision of services by electronic means is concluded as soon as the Participant begins using the services covered by the Regulations.

  4. The contract for the provision of electronic services may be terminated by the Participant at any time by resigning from the Contest.

  5. The technical prerequisite for the use of services provided electronically is to have an installed web browser, e.g. Internet Explorer, Mozilla Firefox, Opera, Chrome, Safari.

  6. The Organizer stipulates that the use of the services covered by the Regulations may involve standard risks associated with the use of the Internet and recommends that Participants take appropriate steps to minimize them.

  7. The Organizer uses its own system security and permanent IT support to ensure the security of transmitted and received data.

  8. The provisions of § 6 of the Regulations shall apply accordingly to complaints about services provided electronically, with the time limit for filing a complaint counting from the moment of occurrence of the event justifying the filing of the complaint.

  9. Matters not regulated in these Regulations with regard to the provision of services by electronic means shall be governed by generally applicable laws, including in particular the Act of July 18, 2002 on the provision of services by electronic means (i.e. Journal of Laws of 2020, item 344).

§ 9

Final provisions

  1. The provisions of these Regulations shall be governed by the laws of Poland. Matters not regulated by these Regulations shall be governed by generally applicable regulations, in particular the provisions of the Civil Code.

  2. The Organizer reserves the right to change the provisions of these Regulations if it is justified by the purpose of the Contest and will not impair the conditions of participation in the Contest.

  3. The rules of the Contests are determined solely by these Regulations.

  4. Save for any liability incurred by the participant that cannot be limited by law, the Founder and Organiser shall not be liable for any personal injury, death or expense incurred by the entrant in their participation in this Promotion and any prize which may result in their participation in this Promotion.

  5. To the extent permitted by applicable law, the Founder and the Organiser shall not be liable under or in connection with these Terms and Conditions, the promotion or any prize for any indirect, special on consequential loss or damage and shall not be liable for any injury or damages arising from the use of the prize(s).

  6. This Regulation has been prepared in two language version: Polish and English. In the event of any discrepancies between the language versions, the Polish version shall prevail.
