§ 1
POSTANOWIENIA OGÓLNE
Niniejszy regulamin (zwany dalej: REGULAMIN KONKURSU, określa zasady, zakres i warunki uczestnictwa w konkursie organizowanym przez Organizatora (zwany dalej: „Konkursem”). Organizatorem konkursu “Dołącz do grona odkrywców Benriach” (zwanego dalej “Konkursem”) jest Digital Brothers sp. z o. o. z siedzibą w Warszawie przy al. Rzeczpospolitej 29C/1, 02-972, KRS 0000509290, NIP 9522129772 (zwana dalej "Organizatorem"). Fundatorem nagród w Konkursie jest Brown-Forman Polska Sp. z o.o. z siedzibą w Warszawie przy ul. Postępu 21D KRS 000055791 (zwana dalej „Fundatorem”). Konkurs przeprowadzany jest na stronie internetowej https://www.benriachdistillery.com/pl-pl/konkurs) Konkurs trwa od dnia 22.09.2023, od godziny 8:00 do dnia 31.10.2023 do godziny 23:39 Regulamin określa zasady udziału w Konkursie i zawiera warunki uczestnictwa, które uczestnik biorący udział w Konkursie (zwany dalej "Uczestnikiem") akceptuje poprzez przystąpienie do udziału w Konkursie. Regulamin Konkursu jest dostępny w siedzibie Organizatora, Fundatora oraz na stronie internetowej https://www.benriachdistillery.com/pl-pl/konkurs ; Celem zapewnienia prawidłowej organizacji i przebiegu Konkursu, a w szczególności w celu dokonania oceny prawidłowości zgłoszeń do Konkursu, Organizator powoła trzyosobową Komisję Konkursową, w skład której wejdzie dwóch członków delegowanych przez Organizatora i jeden członek delegowany przez Fundatora (zwana dalej „Komisją Konkursową”). Konkurs nie jest grą hazardową w rozumieniu ustawy o grach hazardowych z dnia 19 listopada 2009 (tj. Dz. U. z 2018 r., poz. 165, z późn. zm.).
§ 2.
WARUNKI UCZESTNICTWA W KONKURSIE
Uczestnikiem Konkursu może być wyłącznie osoba fizyczna, mająca ukończone 18 lat, posiadająca pełną zdolność do czynności prawnych, posiadająca obywatelstwo polskie oraz posiadająca miejsce stałego zamieszkania w Polsce. Pracownicy Fundatora lub Organizatora, ich rodziny, przedstawiciele i wszystkie inne osoby, które są lub były w jakikolwiek sposób zaangażowane w przygotowanie i realizację tego Konkursu są wyłączone z udziału. Obowiązują wszystkie krajowe i regionalne prawa i przepisy. Organizator jest upoważniony do weryfikacji daty urodzenia w sposób przez siebie określony, w tym na podstawie okazanego dowodu osobistego lub w specjalnym formularzu dostarczonym przez kuriera w trakcie odbioru Nagrody. Aby wziąć udział w Konkursie, osoba przystępująca do Konkursu musi wejść na stronę internetową https://www.benriachdistillery.com/pl-pl/konkurs potwierdzając fakt ukończenia 18 lat. W Konkursie można brać udział wyłącznie osobiście, tj. niedopuszczalne jest podawanie danych innych osób trzecich i dokonywanie zgłoszeń konkursowych w ich imieniu. Uczestnictwo w Konkursie polega na spełnieniu oznaczonych w §4 w niniejszym Regulaminie zadań z zastrzeżeniem, iż w ramach ich realizacji Uczestnicy mają obowiązek przestrzegania wszystkich obowiązujących przepisów prawa, niniejszego Regulaminu, zasad współżycia społecznego. Konkurs będzie się odbywać zgodnie z niniejszym Regulaminem, który stanowi jedyny wiążący dokument regulujący zasady i warunki, na jakich Konkurs jest przeprowadzany. Wszelkie inne materiały informacyjne, w tym reklamowe i marketingowe mają jedynie charakter pomocniczy i nie mogą stanowić jakiejkolwiek podstawy do dochodzenia roszczeń wobec Organizatora lub Fundatora. Niespełnienie któregokolwiek z warunków zgłoszenia udziału w Konkursie lub zgłoszenie po terminie spowoduje nieważność zgłoszenia. Jeden Uczestnik może dokonać jednego Zgłoszenia w Konkursie.
§3.
ODPOWIEDZIALNOŚĆ
Organizator oraz Fundator nie ponosi odpowiedzialności za jakąkolwiek szkodę majątkową lub niemajątkową poniesioną przez Uczestnika w związku z wzięciem udziału w Konkursie, chyba że powstała z winy Organizatora lub Fundatora. Uczestnik ponosi odpowiedzialność w przypadku, gdy jego Zgłoszenie będzie naruszało prawa osób trzecich lub powszechnie obowiązujące przepisy prawa i w tym zakresie zwalnia lub zwolni Organizatora lub Fundatora z wszelkiej odpowiedzialności. Organizator lub Fundator nie będzie ponosić odpowiedzialności za inne okoliczności mające wpływ na przyznanie lub nieprzyznanie Nagrody spowodowane przez działanie czynników pozostających poza kontrolą Organizatora lub Fundatora. Organizator lub Fundator nie ponosi odpowiedzialności za nieprawidłowości związane z działaniem lub zaniechaniem osób trzecich biorących udział w obsłudze Konkursu. Organizator lub Fundator nie ponosi odpowiedzialności za problemy techniczne skutkujące problemami z komunikacją, systemami informatycznymi, działanie lub brak działania systemów informatycznych bądź w jakikolwiek inny sposób wpływające na ostateczne wyniki Konkursu.
§ 4.
ZASADY KONKURSU
Uczestnik, w Okresie Trwania Konkursu powinien wykonać Zadanie konkursowe polegające na dokończeniu zdania: Jestem odkrywcą smaków whisky, bo… . Odpowiedzi należy udzielić w formularzu na stronie internetowej. Aby zgłosić swoją odpowiedź do konkursu należy w formularzu na stronie internetowej uzupełnić swoje dane kontaktowe oraz zaakceptować niniejszy Regulamin. Zadania konkursowe należy wykonać samodzielnie, muszą być pracami autorskimi, które wcześniej nie były nagradzane ani w jakikolwiek sposób wykorzystywane i publikowane. Uczestnik zgłaszając Zadanie konkursowe oświadcza, iż przysługują mu pełne prawa autorskie osobiste i majątkowe do tego Zadania konkursowego oraz że akceptuje Regulamin i wyraża zgodę na przetwarzanie swoich danych osobowych na warunkach określonych w Regulaminie. Organizator i Fundator zastrzegają sobie prawo do odrzucania Zadań konkursowych, o jakości nie pozwalającej na ich dopuszczenie do Konkursu lub nie spełniających wymagań opisanych w Regulaminie, w tym między innymi Zadań konkursowych zawierających treści obraźliwe, wulgarne i nieprzyzwoite, obrażające uczucia religijne, obyczajowe i narodowe, naruszające obowiązujące normy prawne, moralne i propagujące przemoc itp. Organizator oraz Fundator nie ponosi odpowiedzialności za okoliczności leżące po stronie Uczestnika Konkursu, które uniemożliwiają dostarczenie Nagrody.
§ 5.
ZWYCIĘZCY ORAZ NAGRODY
W terminie 7 dni od zakończenia Konkursu komisja konkursowa, spośród wszystkich Zadań konkursowych, w oparciu o takie kryteria jak zgodność z tematem, oryginalność, twórcze wykonanie, wybierze łącznie 103 najlepsze, w ocenie Komisji Konkursowej Zadań Konkursowych. Spośród 103 wybranych zgłoszeń, 3 zostaną wybrane jako zwycięzcy Nagrody Głównej, 30 zgłoszeń zostanie wybranych jako zwycięzcy Nagrody Drugiego Stopnia, 70 zgłoszeń zostanie wybranych jako zwycięzcy Nagrody Trzeciego Stopnia. Uczestnicy będący autorami Zadania Konkursowego wybranego zgodnie z ust. 1 (dalej: „Zwycięzca”), w terminie do 7 dni od wyłonienia Zwycięzców zostaną poinformowani o wygranej za pośrednictwem wiadomości e-mail z prośbą o potwierdzenie akceptacji nagrody w terminie 5 dni od otrzymania zawiadomienia. Organizator skontaktuje się ze zwycięzcami Nagrody Głównej w ciągu 2 dni roboczych od potwierdzenia przyjęcia przez nich nagrody w celu poinformowania ich o szczegółowych szczegółach wycieczki, które nie zostały jeszcze wyszczególnione online lub w niniejszym Regulaminie. Brak możliwości kontaktu z Zwycięzcą lub ustalenia szczegółowych warunków odbioru Nagrody skutkuje utratą prawa do Nagrody bez prawa Uczestnika do podnoszenia jakichkolwiek roszczeń. Inne Nagrody poza Nagrodami Głównymi zostaną wysłane do Zwycięzców w terminie do 14 dni roboczych od dnia zawiadomienia Organizatora o wygranej. Nagrodami w Konkursie są: 3 Nagrody Główne: wycieczka dla dwóch osób (Zwycięzca konkursu oraz osoba towarzysząca spełniająca wymogi o których mowa par 2 pkt 1 i innych określonych w Regulaminie) do Szkocji w dniach 17-19.11.2023 wraz ze zwiedzaniem destylarni Benriach, o szacunkowej wartości 8000 zł/osoba. Nagroda Główna oznacza wycieczkę na 3 dni (2 noclegi). W skład nagrody wchodzą bilety lotnicze w klasie ekonomicznej na podróż w dwie strony z lotniska w Warszawie, zakwaterowanie w hotelu 4* w jednym pokoju (podwójne łózko lub dwa łóżka), wraz z śniadaniem i kolacją, transfer do/z lotniska do/z hotelu oraz do destylarni. Pokój hotelowy w wersji dla dwóch osób. Zwycięzca i jego osoba towarzysząca podlegają warunkom niniejszego Regulaminu oraz wszelkim warunkom usług świadczonych przez odpowiednich dostawców poszczególnych usług zawartych w Nagrodzie. Fundator oraz Organizator nie ponoszą kosztów związanych z pobytem na miejscu innych niż opisane w Regulaminie ani nie ponoszą odpowiedzialności za jakiekolwiek szkody związane z realizacją Nagrody. Odpowiedzialność za wszelkie wymagania paszportowe i/lub wizowe związane z wjazdem do Szkocji przez polskiego rezydenta ponosi Zwycięzca Nagrody 30 Nagród Drugiego Stopnia: butelka Benriach The Sixteen o wartości 360 zł. 70 Nagród Trzeciego Stopnia: zestaw Benriach do tastingu składający się z trzech butelek o pojemności 50 ml każda - single malt Benriach (Benriach The Original Ten; Benriach The Smoky Ten; Benriach The Twelve. zwycięzca Nagrody Głównej otrzyma także Nagrodę Dodatkową w postaci kwoty równej 10% wartości Nagrody Głównej, która to kwota zostanie przekazana bezpośrednio do odpowiedniego urzędu skarbowego właściwego dla Zwycięzcy jako podatek od Nagrody.
Realizacja Nagrody Głównej podlega wszelkim ograniczeniom wynikającym z obowiązujących wytycznych sanitarnych oraz epidemiologicznych oraz warunków realizacji usług przez odpowiednie podmioty – np. linie lotnicze
§ 6.
DANE OSOBOWE UCZESTNIKÓW
Biorąc udział w Konkursie, każdy zwycięzca przyjmuje do wiadomości i wyraża zgodę na wykorzystanie jego nazwiska i wizerunku w uzasadnionych przyszłych celach reklamowych w celach marketingowych lub promocyjnych bez dodatkowego wynagrodzenia. O ile Uczestnik nie zaznaczył, że chciałby otrzymywać w przyszłości komunikaty od Fundatora, jego dane osobowe będą przechowywane wyłącznie w celu administrowania promocją i nie będą przechowywane po zakończeniu Konkursu i zakończ się po tym jak zwycięzca otrzyma swoją Nagrodę. Uczestnicy przyjmują do wiadomości, że Brown-Forman Corporation (BROWN-FORMAN) i inne spółki grupy BROWN-FORMAN (szczegóły dostępne na oddzielne żądanie) lub agenci, partnerzy lub licencjobiorcy BROWN-FORMAN będą przetwarzać dane osobowe zgodnie z z polityką prywatności BROWN-FORMAN https://legal.brown-forman.com/privacy-policy/polish, w uzasadnionych celach biznesowych, takich jak dostarczanie spersonalizowanych usług i treści, analizowanie i wdrażanie sposobów ulepszenia naszych usług oraz produktów i odpowiadanie na ich prośby. Dane osobowe mogą być przekazywane do dowolnego kraju, w którym spółki z grupy BROWN-FORMAN lub usługodawcy mają lokalizację, a dane osobowe będą przechowywane zgodnie z obowiązującym prawem. Jeśli w przyszłości Uczestnicy nie życzą sobie otrzymywać dalszych komunikatów od grupy BROWN-FORMAN i woleliby zostać usunięci z jej bazy danych, lub jeśli Uczestnicy chcą sprostować swoje dane lub zmienić sposób otrzymywania od nas komunikatów, prosimy napisać na adres: [email protected].
§ 7.
PRAWA AUTORSKIE
Poprzez fakt zgłoszenia do Konkursu Uczestnik gwarantuje, że przysługują mu wszelkie prawa własności intelektualnej do Zadania Konkursowego [dalej: „Utwór”], w tym wyłączne prawa autorskie osobiste i majątkowe, jak również, że Utwór jest przejawem oryginalnej, własnej twórczości Uczestnika, nie był dotychczas nigdzie publikowany, jak również nie jest obciążony prawami osób trzecich i nie narusza praw osób trzecich. Organizator oraz Fundator zastrzega sobie prawo do wykorzystania Utworów dla celów wewnętrznych, archiwalnych oraz szkoleniowych, a Uczestnik zgadza się na publikację, jak również do dokonania zmian, modyfikacji, w tym skrótów i korzystania z tak zmienionych Utworów zawierających jego wizerunek, w zakresie wskazanym powyżej.
§ 8.
POSTĘPOWANIE REKLAMACYJNE
Wszelkie reklamacje Uczestników dotyczące Konkursu muszą być pod rygorem bezskuteczności złożone na piśmie lub przez email na adres [email protected] w ciągu 14 dni od zakończenia okresu obowiązywania Konkursu na adres siedziby Organizatora. O zachowaniu terminu do wniesienia reklamacji złożonej na piśmie decyduje data stempla pocztowego placówki pocztowej na terenie Rzeczypospolitej Polskie. Reklamacje złożone po terminie i reklamacje niespełniające warunków, o których mowa w § 9. ust. 2. Regulaminu, nie będą rozpatrywane. Organizator rozpatrzy reklamację w terminie 14 (czternastu) dni od dnia jej otrzymania. Uczestnik zostanie powiadomiony o rozpatrzeniu reklamacji niezwłocznie za pośrednictwem poczty elektronicznej, na adres e-mail podany w zgłoszeniu reklamacyjnym lub pocztą na podany adres. Decyzja Organizatora w przedmiocie reklamacji jest ostateczna, co nie wyklucza dochodzenia przez Uczestnika swoich roszczeń na drodze postępowania sądowego.
§ 9.
POSTANOWIENIA KOŃCOWE
W kwestiach nieuregulowanych Regulaminem stosuje się w szczególności przepisy Kodeksu cywilnego oraz inne powszechnie obowiązujące przepisy prawa polskiego. W przypadku jakichkolwiek rozbieżności lub zmian między polskimi warunkami a niniejszymi angielskimi warunkami, angielskie warunki mają pierwszeństwo. Regulamin wchodzi w życie z dniem 22.09.2023 i jest dostępny na stronie internetowej Fundatora https://www.benriachdistillery.com/pl-pl/konkurs. Organizator ponosi odpowiedzialność za wszelkie obowiązki wynikające z przepisów prawa podatkowego związane z rozliczeniem Nagród w Konkursie.

“Join the team of Benriach explorers”
§ 1
GENERAL PROVISIONS
These Regulations (hereinafter: "Regulations"), define the terms, scope and conditions of participation in the contest organized by the Organizer (hereinafter: "Contest"). The organizer of the competition “Join the team of Benriach explorers” (hereinafter referred to as the "Competition") is Digital Brothers sp. z o. o. with its registered office in Warsaw at al. Rzeczpospolitej 29C/1, 02-972, KRS 0000509290, NIP 9522129772 (hereinafter referred to as the "Organizer"). The awards in the Competition are funded by Brown-Forman Polska Sp. z o.o. with headquarter in Warsaw.. at Postępu 21D street, KRS 000055791 (hereinafter referred to as the "Founder"). The competition is carried out on the Founder`s website https://www.benriachdistillery.com/pl-pl/konkurs) The competition starts on September 22nd 2023, from 8:00 until 31.10.2023 by 23:39 The Regulations define the rules of participation in the Competition and contain the conditions of participation that the participant participating in the Competition (hereinafter referred to as the "Participant") accepts by joining the Competition. The Regulations of the Competition are available at the headquarters of the Organizer, Founder and on the Founder's website https://www.benriachdistillery.com/pl-pl/konkurs In order to ensure the proper organization and conduct of the Contest, and in particular to assess the correctness of applications to the Contest, the Organizer will appoint a Contest Committee of three, consisting of two members delegated by the Organizer and one member delegated by the Founder (hereinafter referred to as the "Contest Committee"). The competition is not a gambling game within the meaning of the Gambling Act of November 19, 2009 (i.e. Journal of Laws of 2018, item 165, as amended).
§ 2.
TERMS OF PARTICIPATION IN THE COMPETITION
Only a natural person at least 18 years of age, having full legal capacity, Polish citizenship and permanent residence in Poland may participate in the Competition. Employees of the Founder or Organizer, their families, representatives and all other persons who are or were in any way involved in the preparation and implementation of this Competition are excluded from participation. All national and regional laws and regulations apply. The Organizer is entitled to verify the date of birth in a manner specified by him, including on the basis of the presented ID card or in a special form provided by the courier when collecting the Prize. To participate in the Competition, the person entering the Competition must access the website https://www.benriachdistillery.com/pl-pl/konkurs by confirming age over 18. The Competition can only be participated in person, i.e. it is not allowed to provide personal information of third parties and submit contest entries on their behalf. Participation in the Competition consists in fulfilling the tasks set out in §4 in these Regulations, with the proviso that as part of their implementation, Participants are obliged to comply with all applicable law, these Regulations, and the rules of social coexistence. The Competition will be held in accordance with these Regulations, which are the only binding document regulating the terms and conditions under which the Competition is held. Any other information materials, including advertising and marketing, are only auxiliary and cannot constitute any basis for claims against the Organizer or the Founder. Failure to meet any of the conditions for applying for the Competition or submitting after the deadline will invalidate the application. One Participant may submit one Application in the Competition.
§3.
RESPONSIBILITY
The Organizer and the Founder shall not be liable for any material or non-material damage suffered by the Participant in connection with the participation in the Competition, unless it was caused by the Organizer or the Founder. The Participant is liable in the event that his Application violates the rights of third parties or generally applicable law and in this respect releases or releases the Organizer or Founder from all liability. The Organizer or the Founder will not be liable for other circumstances affecting the awarding or non-awarding of the Prize caused by factors beyond the Organizer's or Founder's control. The Organizer or the Founder is not responsible for any irregularities related to the actions or omissions of third parties participating in the handling of the Competition. The Organizer or Founder is not responsible for technical problems resulting in problems with communication, IT systems, operation or non-operation of IT systems, or in any other way affecting the final results of the Competition.
§ 4.
RULES OF THE COMPETITION
During the Competition Period, the Participant should perform the competition task by completing the sentence 'I am an explorer of whisky flavors because...' in the form on the website. To submit the answer for the Competition, participants must fill out their contact information in the form on the website , and accept the present Terms and Conditions. Competition tasks must be performed on their own, they must be original works that have not been awarded or used or published in any way before. By submitting a Competition Task, the Participant declares that he has full personal and property copyrights to this Competition Task and that he accepts the Regulations and agrees to the processing of his personal data under the conditions specified in the Regulations. The Organizer and the Founder reserve the right to reject the Competition Tasks of a quality that does not allow them to be admitted to the Competition or do not meet the requirements described in the Regulations, including, inter alia, Competition Tasks containing offensive, vulgar and indecent content, offending religious, moral and national feelings, violating applicable legal, moral and violent standards, etc. The Organizer and the Founder are not responsible for any circumstances on the part of the Competition Participant that prevent the delivery of the Prize.
§ 5.
WINNERS AND PRIZES
Within 7 days of the end of the Competition, the competition committee, from among all Competition Tasks and based on such criteria as compliance with the topic, originality, and creative performance, will select a total of 103 Competition Tasks that are the best according to the Competition Committee. Out of the 103 selected answers, 3 will be chosen as winners of the Grand Prize, 30 will be selected as winners of the Second Degree Prize, 70 will be selected as winners of the Third Degree Prize. Participants who are the authors of the Competition Task selected in accordance with sec. 1 (hereinafter: the "Winner"), within 7 days of selecting the Winners, they will be notified of their winnings via email provided during registration will be asked to provide their acceptance of the prize within 5 days of being notified. The Organizer will contact the winners of the Grand Prize within 2 working days of their acceptance of the prize to notify them of specific details of the trip not already detailed online or here in these Terms and Conditions. The inability to contact the Winner or determine the detailed conditions of receiving the Prize results in the loss of the right to the Prize without the Participant's right to raise any claims. All other prizes not deemed to be the Grand Prize i.e. material prizes, will be sent to the Winners within 14 working days from the date of notification by the Organizer to the winner of their win. The prizes in the Competition are: 3 Grand Prizes: a trip for two (Competition Winner and an accompanying person) to Scotland on 17-19.11.2023 with a tour of the Benriach distillery, worth 8000 PLN/per person.. The Grand Prize represents a 3-day trip (2 nights). The prize includes economy round-trip air tickets from Warsaw airport, accommodation in a 4-star hotel based on two people sharing a room (either double or twin) with breakfast and dinner and airport transfers to/from the hotel and to the distillery. The hotel room is based on double occupancy. The winner and their accompanying person are subject to the conditions of these Regulations and any conditions of services provided by the respective suppliers included in the Prize. The Founder and the Organizer do not cover any expenses related to stays other than those described in the Regulations, nor do they accept responsibility for any damages related to the implementation of the Prize. Any required passport requirements and/or visa requirements for entry into Scotland by a Polish resident is the responsibility of the Prize Winner. 30 Second Degree Prizes: Benriach The Sixteen bottle worth 360 PLN. 70 Third Degree Prizes: Benriach tasting set consisting of three 50ml bottles each – single malt Benriach (Benriach The Original Ten; Benriach The Smoky Ten; Benriach The Twelve) the winner of the Grand Prize will also receive an Additional Prize in the form of an amount equal to 10% of the value of the Grand Prize, which will be transferred directly to the appropriate tax office for the Winner as tax on the Prize.
The implementation of the Grand Prize is subject to all restrictions resulting from the applicable sanitary and epidemiological guidelines and the conditions for the provision of services by relevant entities - e.g. airlines.
§ 6.
PERSONAL DATA OF PARTICIPANTS
By participating in the Competition, each winner acknowledges and consents that his / her name and image may be used in reasonable future publicity for marketing or promotional purposes without additional compensation. Unless a Participant has indicated that he/she would like to receive communications from the Founder in the future, his/her personal data will only be held for the purpose of administering the promotion and will not be retained once the prize draw has been concluded and each winner has received their prize. Participants acknowledge that Brown-Forman Corporation (BROWN-FORMAN) and other companies within the BROWN-FORMAN group (details of which are available on request) or BROWN-FORMAN's agents, partners or licensees, will handle their personal information, in accordance with the BROWN-FORMAN privacy policy https://legal.brown-forman.com/privacy-policy/polish, for legitimate business purposes such as to provide you with personalized services and content, to analyze and consider ways of improving our services and products, and to respond to their requests. Their personal information may be transferred to any country where BROWN-FORMAN group companies or our service providers have facilities and personal information will be retained as permitted by applicable law. If in the future, Participants do not wish to receive further communications from the BROWN-FORMAN group and would prefer to be removed from its database, or if Participants wish to make corrections to their details or change how they receive communications from us, please write to: [email protected].
§ 7.
COPYRIGHTS
By entering the Competition, the Participant guarantees that he / she is entitled to all intellectual property rights to the Competition Task [hereinafter: "Work"], including exclusive personal and property copyrights, as well as that the Work is a manifestation of the Participant's original, own creation, was not so far published anywhere, as well as is not encumbered with the rights of third parties and does not infringe the rights of third parties. The Organizer and the Founder reserve the right to use the Works for internal, archival and training purposes, and the Participant agrees to the publication, as well as to make changes, modifications, including shortcuts and use of such changed Works containing his image, to the extent indicated above.
§ 8.
COMPLAINT PROCEDURE
Any complaints from Participants regarding the Competition must be submitted in writing or by e-mail to the address [email protected] within 14 days from the end of the Competition period to the address of the Organiser's seat. The date on the postmark of the post office in the territory of the Republic of Poland shall be decisive for meeting the deadline for submitting a written complaint. Complaints submitted after the deadline and complaints that do not meet the conditions referred to in § 9 sec. 2. of the Regulations, will not be considered. The organizer will consider the complaint within 14 (fourteen) days from the date of its receipt. The participant will be notified of the complaint immediately via e-mail, to the e-mail address provided in the complaint or by post to the address provided. The Organiser's decision on the complaint is final, which does not preclude the Participant from pursuing his claims through court proceedings.
§ 9.
FINAL PROVISIONS
In matters not covered by the Regulations, the provisions of the Civil Code and other generally applicable provisions of Polish law shall apply in particular. In the case of any discrepancy or change between the Polish terms and conditions and these English terms and conditions, the English terms and conditions shall prevail. The Regulations enter into force on 22.09.2023 and are available on the Founder's website https://www.benriachdistillery.com/pl-pl/konkurs The Organizer is responsible for all tax obligations under the tax law related to the settlement of Prizes in the Competition.
