Official Rules
NO PURCHASE NECESSARY. You must be at least 21 years of age and a legal resident of the United States of America. Contest void where prohibited. A purchase or photo upload will not increase your chances of winning.
CONTEST PERIOD: The Whiskey Row Retreat Contest (the “Contest”) begins February 25th, 2020 at 12:01 AM Eastern Time (“ET”) and ends April 20, 2020 at 11:59 PM ET (the “Contest Period”).
HOW TO ENTER: During the Contest Period, visit www.oldforester.com/whiskeyrowretreat and follow the instructions to complete the provided entry form by including full legal name, email and date of birth and in 300 words or less, tell us why you want to stay at Whiskey Row Retreat to receive one (1) entry (“Entry”).
When entering via your mobile phone, standard data fees may apply. See your wireless provider for pricing plan details. All entries must be received by April 20, 2020 at 11:59 PM ET to be eligible. Submission of erroneous or incomplete information will void the submitted entry. Except as otherwise provided herein, Sponsor will not enter into any correspondence with an entrant regarding an entry. Entries generated by script, macro or other automated means or by any means which subvert the entry process are void. Limit one (1) entry per person using only one email address throughout the Contest Period. You may only use one (1) email address to enter. Entries received from any person or email address in excess of the limitation above will be void.
REQUIREMENTS OF ENTRIES: Entry may not contain, as determined by the Sponsor, in its sole discretion, any content that:
Entry must be the original work of the entrant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If the entry contains any material or elements that are not owned by the entrant, and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the entry, any and all releases and consents necessary to permit the use and exhibition of the entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the entry. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, if requested, render entry null and void. By submitting an entry, entrant warrants and represents that he/she and any persons appearing or who are identifiable in the entry consent to the submission and use of the entry in the Contest and to its use as otherwise set forth herein.
By submitting an entry, entrant hereby grants permission for the entry to be posted on the Sponsor’s websites and social media channels. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of entries by third parties. Released Parties do not guarantee the posting of any entry and may remove any posted entry at any time.
JUDGING: One (1) potential winner will be selected by an Old Forester panel of judges on or about April 30, 2020 from among all eligible entries received throughout the Promotion Period. Judging is in the sole discretion of Old Forester and a panel of judges selected by Old Forester. The submissions will be judged based on passion for the brand (Old Forester) and originality/Sponsor reserves the right not to award any prizes if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries. Prize award is subject to verification of eligibility and compliance with these Official Rules.
ELIGIBILITY: Employees of Brown-Forman, their affiliates, as well as the advertising/promotion agency, and the immediate families and household members of each are not eligible to win. Holders of wholesale or retail licenses and their employees are not eligible. You must be at least 21 years of age and a legal resident of the United States.
PRIZES: The potential winner will receive a trip for two (2) to the Old Forester Bourbon Distillery in Louisville, KY, scheduled to take place from June 12-14, 2020 where they will stay in the Old Forester Whiskey Row Retreat apartment on Whiskey Row, the street upon which the Old Forester Bourbon Distillery is located. Trip includes round trip coach class airfare from commercial airport closest to winner’s home to Louisville KY., accommodations (apartment 2 people max.) and hospitality. Winner is responsible for all applicable federal, state and local taxes, if any. A 1099 will be issued. Winner is responsible for any costs and expenses associated with prize acceptance and use not specified herein as being provided. All prize details are at Sponsor’s sole discretion. No prize substitutions or transfers will be allowed, except in Sponsor’s discretion; Sponsor may award a substitute prize of comparable or greater value if any part of this prize becomes unavailable. Prize will be awarded “as is” with no warranty or guarantee, ether express or implied, offered by Sponsor. Approximate retail value of prize is $2,000.
Beverage alcohol is not part of the contest prize. All federal, state and local taxes on prizes are the sole responsibility of prize winner. No substitution or transfer of prizes permitted. Non-cash prizes cannot be redeemed for cash value. Limit one prize per winner. The winner will be notified by a Text Message, phone and/or email. Brown-Forman/Old Forester and participating promotional companies are not in any way liable for damage, loss or injury resulting from computer malfunctions, misdirected or incomplete entries or acceptance and use of the prize. Brown-Forman/Old Forester reserves the right in its sole discretion, to cancel or suspend this contest should virus, bugs or other causes beyond the control of sponsor corrupt the administration, security or proper play of the contest. Brown-Forman/Old Forester reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel terminate or suspend the contest. Brown-Forman/Old Forester assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, theft or destruction or unauthorized access to, or alteration of, entries.
CAUTION: Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the game is a violation of criminal and civil laws and should such an attempt be made, sponsor reserves the right to seek damages from any such attempt. Sponsor reserves the right to seek damages from any such entrant to the fullest extent of the law.
CLAIMING PRIZES/RELEASE: Potential Winner will be notified on or about April 24th, 2020. Potential Winner will be required to sign an affidavit of eligibility and liability release. Winner and guest will also be required to agree to certain rules of occupation in the ‘Retreat’. If these documents are not returned within the allotted time, winner will forfeit prize and an alternate may be drawn. Potential Winner will be notified by phone/text/email. Potential Winner may need to provide mailing address information for delivery of the Prize.
By accepting his or her prize, the winner: (a) releases Brown-Forman/Old Forester and their affiliated companies and licensed alcohol wholesalers and retailers from any all liability claims, action or proceedings arising out of or for injuries or damages sustained while involved in a promotion activity or connection with the use of the prizes; as well as (b) consents to the use by Brown-Forman for promotional and advertising purposes in connection with this promotion and general use of the images submitted with entries, of his or her name and/or likeness and/or voice without further compensation. Proof of identification and age verification will be required. Guest must be at least 21 years of age and may also be required to sign a similar release and occupation rules. Return of prize notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of Sponsor to contact a potential winner within a reasonable time period or noncompliance with these Official Rules by any potential winner will result in disqualification and, at Sponsor’s sole discretion, the applicable prize may be awarded to a runner-up. Unclaimed prize may not be awarded.
