§ 1

Postanowienia ogólne

 

1. Niniejszy regulamin (zwany dalej: „Regulaminem”), określa zasady, zakres i warunki uczestnictwa w konkursie organizowanym przez Organizatora (zwany dalej: „Konkursem”).

2. Organizatorem Konkursu jest Chromatique Julian Pęksa, z siedzibą na ul Szamotulskiej 26, 60-366 w Poznaniu, NIP: 5992712343, REGON: 080445501 (zwany dalej: „Organizatorem”).

3. Fundatorem nagród w Konkursie jest Brown-Forman Polska sp. z o.o. z siedzibą w Warszawie (02-676), przy ul. Postępu 21D, wpisana do rejestru przedsiębiorców Krajowego Rejestru Sądowego prowadzonego przez Sąd Rejonowy dla m. st. Warszawy, XII Wydział Gospodarczy Krajowego Rejestru Sądowego, pod numerem KRS: 00000055791, NIP: 526-00-13-887 REGON 010325438 (zwany dalej: „Fundatorem”).

4. Konkurs będzie przeprowadzony na terytorium Rzeczypospolitej Polskiej (z zastrzeżeniem transgranicznego dostępu do Internetu) od dnia 01.09.2026 r. od godz. 00:00 do dnia 3.01.2027 r. do godz. 23:59 (zwany dalej: „Czasem Trwania Konkursu”) za pomocą zgłoszenia na stronie internetowej: https://www.jackdaniels.com/pl-pl/konkurs

5. Czynności związane z przeprowadzeniem Konkursu, w tym wybór laureatów, powiadomienie o wygranej, wydanie nagród oraz rozpatrzenie ewentualnych reklamacji, zostaną zakończone do dnia 04.03.2027 r. 

 

6. Celem Konkursu jest wyłonienie najbardziej kreatywnych odpowiedzi na pytanie: Jaka historia z Twojego życia mogłaby wydarzyć się w barze w Tennessee? (zwane dalej: „Zadaniem konkursowym”), opisane w § 2 ust. 4 niniejszego Regulaminu, zadane przez Organizatora.

7. Uczestnik nie może przenosić na osoby trzecie uczestnictwa w Konkursie, praw i obowiązków z nim związanych, w tym także prawa do żądania wydania przyznanej nagrody.

8. Udział w Konkursie i podanie związanych z udziałem danych jest całkowicie dobrowolne, a także oznacza, że Uczestnik zapoznał się z Regulaminem Konkursu i w pełni go akceptuje.

9. Organizator oświadcza, że Konkurs nie jest loterią fantową, zakładem wzajemnym, loterią promocyjną, których wynik zależy od przypadku, ani żadną inną grą losową przewidzianą w ustawie z dnia z dnia 19 listopada 2009 r. o grach hazardowych (Dz. U. z 2022 r. poz. 888 z późn. zm.).

10. Ze względu na swój niepubliczny charakter, Konkurs nie stanowi reklamy ani promocji w rozumieniu przepisów ustawy z dnia 26 października 1982 r. o wychowaniu w trzeźwości i przeciwdziałaniu alkoholizmowi (Dz. U. z 2021 r. poz. 1119 z późn. zm.). Celem Konkursu jest nagradzanie osób, które najlepiej wykonały określone w ramach Konkursu zadanie konkursowe opisane w § 2 ust. 4 Regulaminu („Zgłoszenie Konkursowe”), na zasadach i warunkach określonych w niniejszym Regulaminie.

 

§ 2

Zasady uczestnictwa w Konkursie

 

1. W Konkursie mogą brać udział wyłącznie osoby fizyczne, które ukończyły 21 lat i posiadają pełną zdolność do czynności prawnych oraz mające miejsce zamieszkania na terenie Rzeczypospolitej Polskiej.

2. W Konkursie nie mogą brać udziału pracownicy i współpracownicy Organizatora oraz Fundatora. Współpracownikami w rozumieniu Regulaminu są wszystkie osoby współpracujące z Organizatorem lub Fundatorem na podstawie umów cywilnoprawnych. W Konkursie nie mogą również brać udziału członkowie rodzin tych osób. Przez członków rodzin rozumie się: wstępnych, zstępnych, rodzeństwo, małżonków, rodziców małżonków, osób pozostających w stosunku przysposobienia, a także osób pozostających we wspólnym pożyciu.

3. Organizator jest uprawniony do weryfikacji spełnienia warunków uczestnictwa w Konkursie, jeśli zachodzi uzasadnione podejrzenie, że dany Uczestnik działa sprzecznie z niniejszym Regulaminem. Organizator jest uprawniony do wykluczenia Uczestnika z udziału w Konkursie i odmowy przyznania mu nagrody, jeśli nie spełnia warunków uczestnictwa w Konkursie określonych w niniejszym Regulaminie lub też w przypadku powzięcia uzasadnionych podejrzeń, iż fotografia lub tekst zamieszczone przez Uczestnika w wykonaniu Zadania Konkursowego naruszają prawa osób trzecich lub też naruszają postanowienia ust. 8 i 13 poniżej.

4. Aby wziąć udział w Konkursie i zawalczyć o Nagrody należy:

 

1. w Czasie Trwania Konkursu kupić dowolną butelkę alkoholu Jack Daniel’s lub dowolny koktajl na bazie Jack Daniel’s; z zastrzeżeniem ust. 4 pkt 4a niniejszego paragrafu;

2. na stronie internetowej https://www.jackdaniels.com/pl-pl/konkurs udzielić odpowiedzi na pytanie: Jaka historia z Twojego życia mogłaby wydarzyć się w barze w Tennessee?

3. dodać zdjęcie/skan paragonu z którego będzie wynikać data oraz zakup dowolnej butelki alkoholu Jack Daniel’s lub dowolny koktajl na bazie Jack Daniel’s (zwane dalej: „Zgłoszeniem konkursowym”).

 

4a. Dopuszcza się również udział w Konkursie na podstawie zakupu koktajlu przygotowanego na bazie produktu Jack Daniel’s, zamiast zakupu butelki, o którym mowa w ust. 4 pkt 1 powyżej.

W takim przypadku Uczestnik zobowiązany jest do załączenia do Zgłoszenia konkursowego paragonu lub innego dowodu zakupu, na którym w sposób jednoznaczny wskazane jest, że zakupiony napój był koktajlem przygotowanym na bazie produktu Jack Daniel’s.

Paragony, które nie zawierają wyraźnej informacji pozwalającej na identyfikację wykorzystania produktu Jack Daniel’s, nie stanowią podstawy do uwzględnienia zgłoszenia w Konkursie.

5. Uczestnik poprzez dokonanie Zgłoszenia konkursowego gwarantuje, że posiada pełne prawa autorskie do stworzonej wypowiedzi (zgodnie z ustawą o prawie autorskim i prawach pokrewnych).

6. W czasie trwania Konkursu, określonym w § 1 ust. 4 niniejszego Regulaminu, Uczestnik może przesłać dowolną ilość zgłoszeń konkursowych. Aby zgłoszenie było skuteczne, towarzyszyć mu musi dowód zakupu butelki Jack Daniel’s lub koktajlu przygotowanego na bazie produktu Jack Daniel’s. Zakazane jest korzystanie przez jedną osobę z wielu kont e-mailowych oraz rejestracji więcej niż jeden raz jednego paragonu. W przypadku powstania uzasadnionego podejrzenia o korzystaniu przez Uczestnika z różnych kont e-mail, oraz wykorzystania jednego paragonu do więcej niż jednego zgłoszenia, wszelkie zgłoszenia takiej osoby zostaną usunięte i nie będą brały udziału w Konkursie.

7. Uczestnik może w każdej chwili zrezygnować z udziału w Konkursie, poprzez poinformowanie o tym fakcie Organizatora.

8. Uczestnik, z chwilą dodania Zgłoszenia konkursowego udziela Organizatorowi nieodpłatnej, lecz niewyłącznej licencji do korzystania z przedmiotów praw własności intelektualnej zawartych w danym Zgłoszeniu Konkursowym (niezależnie od otrzymania przez Uczestnika nagrody), w szczególności z utworów w rozumieniu ustawy z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych, z późn. zm., bez ograniczeń terytorialnych, czasowych lub ilościowych, z prawem do udzielania sublicencji, na następujących polach eksploatacji:

a. utrwalenie i zwielokrotnienie dowolną techniką w tym w szczególności techniką drukarską;

b. wprowadzenie do obrotu;

c. wykorzystanie całości i pojedynczych elementów dla potrzeb stworzenia dowolnych materiałów reklamowych (przykładowo reklamy prasowe, ulotki, plakaty o dowolnych rozmiarach, materiały okolicznościowe) oraz korzystanie z nich w ramach materiałów reklamowych, poprzez ich utrwalanie i zwielokrotnianie technikami opisanymi w punkcie a. powyżej, oraz wprowadzenie do obrotu, rozpowszechnianie, najem, użyczenie, a także publiczne udostępnianie w taki sposób, aby każdy mógł mieć do nich dostęp w miejscu i w czasie przez siebie wybranym;

d. rozpowszechnianie i udostępnianie w sieci Internet poprzez wprowadzenie do pamięci komputera bez względu na ilość nadań, emisji, wytworzonych egzemplarzy;

e. rozpowszechnianie w jakikolwiek inny sposób w całości lub części, nadawanie za pomocą wizji, fonii przewodowej i bezprzewodowej przez stacje naziemne, za pośrednictwem satelity, wystawienie, wyświetlenie, publiczne odtworzenie, publiczne wykonanie, nadawanie w sposób równoczesny i integralny z inną organizacją lub podmiotem radiowym lub telewizyjnym, publiczne udostępnienie utworu w taki sposób, aby każdy mógł mieć do niego dostęp w miejscu i w czasie przez siebie wybranym;

f. najem, dzierżawa, zarejestrowanie utworu jako znaku towarowego, wzoru użytkowego lub przemysłowego.

9. Na mocy licencji określonej powyżej, utwór Uczestnika zawarty w Zgłoszeniu konkursowym może być wykorzystany w dowolny sposób, przetworzony, rozpowszechniony w całości lub w części, w połączeniu z innymi dziełami, może zostać zmieniony, opracowany, w szczególności w celu promocji i reklamy, w tym formie plakatów, folderów, w tym reklam audiowizualnych. Uczestnik wyraża zgodę na korzystanie i rozporządzanie opracowaniem jego utworu (zgoda na wykonywanie praw zależnych), z prawem do dalszego upoważnienia do wykonywania praw zależnych.

10. Organizator upoważniony jest do wykorzystania utworu w sposób anonimowy.

11. Zgłoszenie konkursowe powinno być zgodne z prawem oraz ogólnie przyjętymi normami obyczajowymi, w tym: nie może zawierać treści powszechnie uznanych za obraźliwe, nie może godzić w uczucia religijne i polityczne osób trzecich czy naruszać praw osób trzecich.

12. Uczestnik na życzenie Organizatora zawrze z nim w formie pisemnej odrębną umowę licencji wyłącznej lub przeniesienia autorskich praw majątkowych do utworów zawartych w danym Zgłoszeniu konkursowym.

13. Niedopuszczalne jest zgłaszanie do Konkursu Zgłoszenia konkursowego, które:

1. Narusza prawa osób trzecich, w szczególności prawa autorskie i pokrewne, dobra osobiste oraz prawa własności intelektualnej;

2. Zawiera treści niezgodne z prawem lub dobrymi obyczajami, w szczególności obraźliwe, wulgarne, pornograficzne, propagujące przemoc, nienawiść rasową lub religijną;

3. Zawiera przekazy reklamowe;

4. Zawiera odnośniki do innych stron internetowych;

5. Zostały stworzone przy udziale sztucznej inteligencji.

14. Uczestnik ponosi odpowiedzialność za powstałe z tytułu rozpowszechnienia przez Organizatora Zgłoszenia konkursowego szkody, tym samym zwalniając Organizatora z ewentualnych roszczeń z tego tytułu. 

 

§ 3

Nagrody w Konkursie

 

1. a. 3 nagrody I stopnia, każda nagroda stanowi dwuosobowy wyjazd do Tennessee o wartości 19 924,16 zł (słownie: dziewiętnaście tysięcy dziewięćset dwadzieścia cztery złote szesnaście groszy). Łączna wartość nagród I stopnia wynosi 179 317,45 zł (słownie: sto siedemdziesiąt dziewięć tysięcy trzysta siedemnaście złotych czterdzieści pięć groszy).

 

b. 300 nagród II stopnia, z których każda stanowi zestaw Jack Daniel's zawierający plecak oraz butelkę alkoholu Jack Daniel's pojemności 0,7 l, o wartości 150 zł (słownie: sto pięćdziesiąt złotych) każda. Łączna wartość nagród II stopnia wynosi 45 000 zł (słownie: czterdzieści pięć tysięcy złotych).

 

2. Nagroda Główna składa się z: 6-dniowego, 4-nocnego wyjazdu dla zwycięzcy nagrody oraz osoby towarzyszącej do Tennessee. Planowana data wyjazdu to 31.03-5.04.2027. Organizator zastrzega sobie jednak prawo do zmiany terminu wyjazdu z przyczyn niezależnych od Organizatora, w szczególności w przypadku wystąpienia okoliczności uniemożliwiających lub utrudniających jej realizację w pierwotnie planowanym terminie. O ewentualnej zmianie terminu Organizator poinformuje uczestników z odpowiednim wyprzedzeniem. Organizator dokona rezerwacji i pokryje koszty nagrody jako agent zwycięzcy nagrody i jego osoby towarzyszącej, którzy wyrażają zgodę na przestrzeganie wszelkich warunków narzuconych przez strony trzecie, w tym, bez ograniczeń, odpowiedniego operatora turystycznego. Zwycięzca nagrody oraz osoba towarzysząca muszą posiadać ważny paszport o co najmniej 6-miesięcznej ważności, a w przypadku jego braku, nie mogą wymagać wcześniejszej wizy w celu podróży do USA. Zwycięzca oraz jego gość muszą posiadać ważny paszport oraz wizę do Stanów Zjednoczonych lub zezwolenie na podróż (ESTA), chyba że są posiadaczami zielonej karty. Zwycięzca oraz jego gość muszą spełniać wymagania imigracyjne (oraz wymagania dotyczące Covid - 19) dotyczące wjazdu do Stanów Zjednoczonych. Wszelkie kwestie administracyjne związane z podróżą spoczywają na Zwycięzcy oraz jego gościu. Wszelkie dodatkowe wydatki, w tym wydatki dodatkowe, podróż do i z lotniska wylotowego oraz zapewnienie ubezpieczenia są obowiązkiem Zwycięzcy. Organizator zastrzega sobie prawo do wyboru alternatywnego zwycięzcy w przypadku, gdy pierwotny zwycięzca i jego osoba towarzysząca nie zweryfikują swojej tożsamości, wieku, zdolności do odbycia wyjazdu w określonych terminach oraz zgodności z wymogami imigracyjnymi USA do dnia 24.02.2027 r. Wskazany termin stanowi ostateczny termin na przekazanie Organizatorowi informacji i dokumentów niezbędnych do realizacji Nagrody w terminach określonych w Regulaminie.

 

3. Każdy Uczestnik może wygrać tylko jedną Nagrodę danego typu w Konkursie.

 

4. Zwycięzców Konkursu (dalej zwanych: „Laureatami”) wybierze Komisja Konkursowa wybrana przez Organizatora (dalej zwana: „Komisją Konkursową”). W skład Komisji Konkursowej wchodzą trzy osoby wybrane przez Organizatora.

 

5. Wyłączone jest prawo żądania przez Laureata wypłaty równowartości nagrody w gotówce bądź prawo jej zamiany na inną nagrodę.

 

6. Laureat nagrody o której mowa w § 3 ust. 1 lit. a. zostanie poinformowany do dnia 18.01.2026 r. do godz. 23:59.

 

§ 4

Zasady przyznawania Nagród w Konkursie

 

1. Spośród wszystkich Zgłoszeń Konkursowych Komisja Konkursowa powołana przez Organizatora wybierze najbardziej kreatywne Zgłoszenia konkursowe, które zostaną nagrodzone Nagrodami w ramach niniejszego Konkursu, zgodnie z zasadami opisanymi w § 2 Regulaminu. Przy wyborze Laureatów Komisja Konkursowa kierować się będzie swoim własnym uznaniem, biorąc pod uwagę oryginalność oraz kreatywność przy wykonaniu Zadania konkursowego.

 

2. Wybór zwycięzców nagród będzie odbywał się po zakończeniu Konkursu spośród wszystkich zgłoszeń, które wpłynęły do dnia zakończenia Konkursu.

 

3. Laureaci Konkursu zostaną powiadomieni o wygranej za pośrednictwem wiadomości e-mail podanej podczas rejestracji do dnia 18.01.2026 r. do godz. 23:59. 

 

4. Z prac Komisji Konkursowej zostaną sporządzone protokoły.

 

5. Laureatom którzy otrzymają Nagrody, Organizator przyzna dodatkowo nagrodę pieniężną, przeznaczoną na pokrycie kosztów podatku dochodowego od Nagród. Wysokość dodatkowej nagrody pieniężnej stanowi 11,11% wartości Nagrody, przy czym kwota dodatkowej nagrody pieniężnej zostanie zaokrąglona do pełnego złotego w ten sposób, iż końcówka mniejsza niż 50 groszy zostanie pominięta, a końcówka równa lub większa od 50 groszy zostanie zaokrąglona w górę do pełnego złotego. Dodatkowa nagroda pieniężna nie zostanie wydana Laureatom, lecz zostanie przeznaczona na pokrycie podatków, o których mowa w zdaniu

poprzedzającym.

 

6. Organizator jako płatnik zryczałtowanego podatku dochodowego od osób fizycznych, przed wydaniem zdobywcy Nagrody obliczy, pobierze i odprowadzi do właściwego Urzędu Skarbowego zryczałtowany podatek dochodowy należny z tytułu wygranej. Zdobywca Nagrody jest zobowiązany przekazać Organizatorowi wszelkie dane niezbędne do wypełnienia wyżej wskazanych obowiązków.

 

7. Organizator nie ponosi odpowiedzialności w przypadku niemożności powiadomienia Laureata o wygranej z powodu podania przez Uczestnika błędnego adresu e-mail lub zmiany adresu e-mail w czasie trwania Konkursu.

 

§ 5

Zasady wydawania Nagród w Konkursie

 

1. O fakcie wygranej oraz sposobie wydania nagrody, Organizator poinformuje Laureatów za pośrednictwem wiadomości e-mail, na adres wskazany podczas rejestracji.

 

2. Organizator w wiadomości, o której mowa powyżej, zażąda od Laureatów podania danych niezbędnych do wydania nagrody, takich jak:

1. imię i nazwisko Uczestnika oraz numer telefonu pozwalający na kontakt z Uczestnikiem;

2. adres, na który ma zostać wysłana Nagroda (jeśli jest inny niż adres zamieszkania);

3. danych wymaganych przepisami prawa podatkowego na cele sprawozdawczości podatkowej związanej z realizacją Konkursu, w szczególności adres zamieszkania, PESEL, właściwy urząd skarbowy.

 

3. Laureat zobowiązany jest przesłać dane, o których mowa w ust. 2 w terminie 3 dni od otrzymania wiadomości od Organizatora. Nie wysłanie przez Laureata danych, o których mowa w ust. 2 powyżej, w terminie wskazanym w zdaniu pierwszym oznacza utratę prawa Uczestnika do Nagrody.

 

4. W przypadku braku możliwości powiadomienia Laureata o wygraniu Nagrody, braku kontaktu ze strony Laureata we wskazanym terminie, lub w przypadku nie podania wymaganych danych przez Zwycięzcę Konkursu w terminie 3 dni od dnia powiadomienia Laureata o wygranej, bądź podania nieprawdziwych danych, nagroda nie zostanie przyznana, a Laureat traci prawo do nagrody. W takim przypadku Organizator powtarzając procedurę powiadomienia o wygranej skontaktuje się z kolejną osobą, która zajęła kolejne, niższe miejsce w Konkursie bądź zdecyduje o przepadku Nagrody.

 

5. Nagrody (z wyłączeniem Nagrody Głównej) zostaną wysłane kurierem przez Organizatora na adres wskazany przez Uczestnika w wiadomości, o której mowa w ust. 3 powyżej w ciągu 30 dni od dnia przekazania przez Laureata danych niezbędnych do wydania Nagrody.

 

6. Organizator nie przewiduje informowania Uczestników, którzy nie zostali zwycięzcami, o ich indywidualnych wynikach w Konkursie.

 

7. Podmiotem wydającym Nagrody w Konkursie jest Organizator.

 

8. Laureaci Nagrody Głównej oraz ich osoby towarzyszące mogą być poproszone o wyrażenie zgody na nieodpłatne wykorzystanie ich wizerunku, w celu stworzenia materiału filmowego z wyjazdu, który Organizator wykorzysta w celach promocyjnych. Zgoda jest dobrowolna i nie stanowi warunku otrzymania nagrody.

 

§ 6

Postępowanie reklamacyjne

 

1. Reklamacje dotyczące Konkursu należy składać pisemnie na adres pocztowy: Chromatique Julian Pęksa, ul Szamotulska 26, 60-366 Poznań z dopiskiem “reklamacja” lub za pośrednictwem poczty elektronicznej, pod adresem [email protected]

 

2. Reklamacje można składać do dnia 25.01.2027. Będą rozstrzygane w terminie 14 dni od daty otrzymania danej reklamacji przez Komisję Konkursową powołaną przez Organizatora. Decyzja Komisji Konkursowej, co do zgłoszonej reklamacji jest ostateczna. Od decyzji Komisji Konkursowej nie przysługuje odwołanie do innych organów Organizatora.

 

3. Reklamacje można wnosić w czasie Trwania Konkursu oraz nie później niż w terminie 7 dni od daty rozstrzygnięcia Konkursu. Po upływie tego terminu reklamacje nie będą uwzględniane.

 

4. Prawidłowo złożona reklamacja powinna zawierać: imię, nazwisko, dokładny adres Uczestnika oraz powody reklamacji.

 

5. Uczestnik zostanie powiadomiony o rozpatrzeniu reklamacji pisemnie lub za pośrednictwem wiadomości e-mail, w zależności od formy złożenia reklamacji przez Uczestnika.

 

§ 7

Dane osobowe

 

1. Dane osobowe będą przetwarzane wyłącznie w celu przeprowadzenia Konkursu, w tym obsługi procesu wyłonienia zwycięzców oraz wydania nagród. 

 

2. Uczestnicy przyjmują do wiadomości, że Brown-Forman Corporation (BROWN-FORMAN), spółka-matka Założyciela, oraz inne spółki wchodzące w skład grupy BROWN-FORMAN (szczegóły dostępne na życzenie) lub pracownicy, agenci, partnerzy lub licencjobiorcy BROWN-FORMAN, będą przetwarzać ich danych osobowych, zgodnie z polityką prywatności BROWN-FORMAN https://legal.brown-forman.com/privacy-policy/polish, w zakresie niezbędnym do realizacji Konkursu. Dane osobowe uczestników mogą być przekazywane do dowolnego kraju, w którym spółki z grupy BROWN-FORMAN lub nasi usługodawcy posiadają obiekty, a dane osobowe będą przechowywane w zakresie dozwolonym przez obowiązujące prawo. Jeżeli w przyszłości uczestnicy woleliby zostać usunięci z bazy danych, lub jeśli chcą poprawić swoje dane lub zmienić sposób otrzymywania od nas wiadomości, prosimy napisać na adres: [email protected]

 

§ 8

Świadczenie usług drogą elektroniczną

 

1. W ramach Konkursu Organizator świadczy nieodpłatnie na rzecz Uczestników, na zasadach opisanych w niniejszym Regulaminie, usługi drogą elektroniczną w zakresie niezbędnym do realizacji Konkursu.

 

2. Przez usługi świadczone drogą elektroniczną na potrzeby Konkursu należy rozumieć takie usługi jak:

1. udostępnienie Regulaminu;

2. umożliwienie zapoznania się z Zadaniem Konkursowym;

3. umożliwienie wzięcia udziału w Konkursie.

 

3. Umowa o świadczenie usług drogą elektroniczną zostaje zawarta z chwilą, gdy Uczestnik rozpocznie korzystanie z usług objętych Regulaminem.

 

4. Umowa o świadczenie usług drogą elektroniczną może być w każdej chwili rozwiązana przez Uczestnika poprzez rezygnację z uczestnictwa w Konkursie.

 

5. Warunkiem technicznym niezbędnym do korzystania z usług świadczonych drogą elektroniczną jest posiadanie zainstalowanej przeglądarki internetowej np. Microsoft Edge, Mozilla Firefox, Opera, Chrome, Safari.

 

6. Organizator zastrzega, że korzystanie z usług objętych Regulaminem może wiązać się ze standardowym ryzykiem związanym z wykorzystaniem sieci Internet i rekomenduje Uczestnikom, przedsięwzięcie odpowiednich kroków w celu ich zminimalizowania.

 

7. Organizator korzysta we własnym zakresie z zabezpieczeń systemowych i stałej pomocy informatycznej zapewniając bezpieczeństwo przesyłanych i odbieranych danych.

 

8. Do reklamacji usług świadczonych drogą elektroniczną stosuje się odpowiednio postanowienia § 6 Regulaminu, przy czym termin na zgłoszenie reklamacji liczy się od momentu wystąpienia zdarzenia uzasadniającego złożenie reklamacji.

 

9. W sprawach nieuregulowanych w niniejszym Regulaminie w zakresie świadczenia usług drogą elektroniczną zastosowanie mają powszechnie obowiązujące przepisy prawa, w tym w szczególności ustawa z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną (t.j. Dz. U. z 2020 r. poz. 344).

 

10. Niniejszy Regulamin Konkursu dostępny jest dla Uczestników w siedzibie Organizatora oraz na stronie internetowej https://www.jackdaniels.com/pl-pl/konkurs.

 

§ 9

Postanowienia końcowe

 

1. Postanowienia niniejszego Regulaminu podlegają przepisom prawa polskiego. W sprawach nieuregulowanych niniejszym Regulaminem zastosowanie znajdować będą powszechnie obowiązujące przepisy, a w szczególności przepisy Kodeksu cywilnego.

 

2. Organizator zastrzega sobie prawo zmiany postanowień niniejszego Regulaminu, jeżeli jest to uzasadnione celem Konkursu i nie wpłynie na pogorszenie warunków uczestnictwa w Konkursie.

 

3. Zasady przeprowadzania Konkursów określa wyłącznie niniejszy Regulamin.

 

4. Organizator i Fundator nie ponoszą odpowiedzialności za jakiekolwiek obrażenia ciała, śmierć, szkody ani koszty poniesione przez Uczestnika w związku z udziałem w Konkursie. Od momentu przekazania Nagrody odpowiedzialność za wszelkie zdarzenia, w tym szkody wynikające ze zdarzeń losowych, działania siły wyższej lub niewłaściwego korzystania z Nagrody, spoczywa na przewoźniku, biurze podróży, innym podmiocie realizującym Nagrodę oraz na samym Zwycięzcy, z wyjątkiem odpowiedzialności, której zgodnie z obowiązującymi przepisami prawa nie można wyłączyć ani ograniczyć.

§ 1

General provisions

 

1. These Regulations (hereinafter: "Regulations"), define the rules, scope and conditions of participation in the contest organized by the Organizer (hereinafter: "Contest").

2. The Organizer of the Contest is Chromatique Julian Pęksa, located at 26 Szamotulska Street, 60-366 in Poznań, NIP: 5992712343, REGON: 080445501

(hereinafter: "Organizer").

3. The Founder of the prizes in the Contest is Brown-Forman Polska sp. z o.o., with its registered office in Warsaw (02-676), at 21D Postępu Street, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the City of Warsaw, XII Economic Department of the National Court Register, under KRS: 00000055791, NIP: 526-00-13-887 REGON 010325438 (hereinafter: "Founder").

4. The Contest will be conducted on the territory of the Republic of Poland

(subject to cross-border access to the Internet) from 01.09.2026 from 00:00 a.m. to 3.01.2027 until 11:59 p.m. (hereinafter referred to as the "Contest Duration") by means of an application on the website: https://www.jackdaniels.com/pl-pl/konkurs

5. Activities relating to the running of the Competition, including the selection of winners, notification of winners, the presentation of prizes and the handling of any complaints, will be completed by 4 March 2027.

6. The purpose of the Contest is to select the most creative answers to the question: What's a story from your life that could have taken place in a bar in Tennessee? (hereinafter: the "Contest Task"), described in § 2.4 of these Regulations, asked by the Organizer.

7. Participant may not transfer to third parties participation in the Contest, rights and obligations related to it, including the right to claim the awarded prize.

8. Participation in the Contest and providing data related to participation is completely voluntary, and also means that the Participant has read the Contest Regulations and fully accepts them.

9. The Organizer declares that the Contest is not a lottery, mutuel betting, promotional lottery, the results of which depend on chance, or any other game of chance provided for in the Act of November 19, 2009 on gambling games (Journal of Laws of 2022, item 888, as amended).

10. Due to its non-public nature, the Competition does not constitute advertising or promotion within the meaning of the provisions of the Act of October 26, 1982 on Upbringing in Sobriety and Counteracting Alcoholism (Journal of Laws of 2021, item 1119, as amended). The purpose of the Contest is to reward the persons who best performed the Contest task described in  § 2.4 of the Regulations ("Contest Entry"), as specified in the Contest, under the terms and conditions set forth in these Regulations.

 

§ 2

Rules of participation in the Contest

 

1. Only natural persons who are at least 21 years of age, have full legal capacity and reside in the Republic of Poland may participate in the Contest.

 

2. Employees and cooperators of the Organizer and the Founder cannot participate in the Contest. Collaborators in the meaning of the Regulations are all persons cooperating with the Organizer or the Founder on the basis of civil law contracts. Also, family members of such persons cannot participate in the Contest. Family members are understood as: ascendants, descendants, siblings, spouses, parents of spouses, persons in an remaining in a relationship of adoption, as well as persons in cohabitation.

3. The Organizer is entitled to verify the fulfillment of the conditions of participation in the Contest, if there is a reasonable suspicion that a given Participant acts in violation of these Regulations. The Organizer has the right to exclude an Entrant from the Contest and refuse to award him/her the prize, if he/she does not meet the conditions of participation in the Contest specified in these Regulations, or in the case of a justified suspicion that the photograph or text posted by the Entrant in the performance of the Contest Task violate the rights of third parties, or violate the provisions of paragraphs 8 and 13 below.

4. In order to participate in the Contest and compete for Prizes, one must:

 

1. buy any bottle of Jack Daniel's alcohol or any Jack Daniel’s-based cocktail during the Contest Period subject to point 4a of subsection 4 of this paragraph;

 

2. answer the question: What's a story from your life that could have taken place in a bar in Tennessee? at https://www.jackdaniels.com/pl-pl/konkurs

3. add a photo/scan of the receipt showing the date and purchase of any bottle of Jack Daniel's alcohol or any Jack Daniel’s-based cocktail (hereinafter: "Contest Entry”).

 

4a. Participation in the Contest is also permitted on the basis of purchasing a cocktail prepared with Jack Daniel’s products, instead of purchasing a bottle as referred to in section 4 point 1 above.

In such a case, the Participant is required to attach to the Contest Entry a receipt or other proof of purchase clearly indicating that the purchased beverage was a cocktail prepared with Jack Daniel’s product.

Receipts that do not contain clear information allowing the identification of the use of Jack Daniel’s product do not constitute grounds for the entry to be considered in the Competition.

5. By making a Contest Entry, the Participant guarantees that he/she owns full copyrights to the created statement (according to the Law on Copyright and Related Rights).

6. A Participant may submit any number of Contest E n t r i e s during the Contest period specified in § 1.4 of these Regulations. To be effective, the entry must be accompanied

by proof of purchase of a bottle of Jack Daniel's or a cocktail made with Jack Daniel’s. It is prohibited for one person to use multiple e-accounts and registration more than once of a single receipt. In the event that a reasonable suspicion arises that an Entrant uses different e- mail accounts, and uses one receipt for more than one entry, all entries of such person will be deleted and will not participate in the Contest.

7. The Entrant may withdraw from the Contest at any time by notifying the Organizer.

8. The Participant, at the moment of adding the Contest Entry, grants the Organizer a free, but non-exclusive license to use the objects of intellectual property rights contained in the given Contest Entry (regardless of the Participant's receipt of the prize), in particular works in the meaning of the the Act of 4 February 1994 on copyright and related rights, as amended, without territorial, time or quantity limitations, with the right to grant sublicenses, in the following fields of exploitation:

a. fixation and reproduction by any technique, including in particular by printing;

b. marketing;

c. use of the whole and individual elements for the creation of any advertising materials (for example, press advertisements, flyers, posters of any size, occasional materials) and use of them as part of advertising materials, through their fixation and multiplication by techniques described in section a. above, and marketing, distribution, rental, lending, as well as public making them available in such a way that anyone can have access to them at a place and time of their own choosing;

d. dissemination and making available on the Internet by entering into computer memory regardless of the number of broadcasts, emissions, copies produced;

e. dissemination by any other means in whole or in part, broadcasting by means of vision, wired and wireless sound by terrestrial stations, via satellite, exhibition, display, public performance, public reproduction, public performance, broadcasting in a simultaneous and integral manner with another organization or radio or television entity, making the work available to the public in such a way that everyone can have access to it at a place and time of their own choosing;

f. lease, rental, registration of the work as a trademark, utility model or industrial design.

9. Under the license set forth above, the Participant's work contained in the Contest Entry may be used in any way, processed, distributed in whole or in part, combined with other works, may be altered, developed, especially for the purpose of promotion and advertising, including the form of posters, brochures, including audiovisual advertisements. The participant agrees to use and dispose of the development of his work (permission to exercise subsidiary rights), with the right to further authorize the exercise of subsidiary rights.

10. The organizer is authorized to use the work anonymously.

11. The contest entry should comply with the law and generally accepted moral norms, including: it cannot contain content generally considered offensive, it cannot offend the religious or political feelings of third parties or violate the rights of third parties.

12. At the request of the Organizer, the Participant shall conclude with the Organizer in writing a separate agreement on the exclusive license or transfer of author's economic rights to the works contained in a given Competition Entry.

13. It is inadmissible to submit a Contest Entry that:

1. Violates the rights of third parties, in particular copyright and related rights, personal rights and intellectual property rights;

2. Contains content that is against the law or good morals, in particular offensive, vulgar, pornographic, promoting violence, racial or religious hatred;

3. Contains advertising messages;

4. Contains links to other websites;

5. Have been created with the help of artificial intelligence.

14. The Participant shall be liable for damages arising from the Organizer's dissemination of the Contest Entry, thereby releasing the Organizer from any claims in this regard.

 

§ 3

Prizes in the Contest

 

1. a. 3 first-prize awards, each consisting of a trip for two to Tennessee, with a value of PLN 19,924.16 (in words: nineteen thousand nine hundred and twenty-four zlotys and sixteen groszy). The total value of the first-prize awards is PLN 179,317.45 (in words: one hundred and seventy-nine thousand three hundred and seventeen zlotys and forty-five groszy).

 

b. 300 second-prize awards, each consisting of a Jack Daniel’s set comprising a backpack and a 0.7-litre bottle of Jack Daniel’s, with a value of PLN 150 (in words: one hundred and fifty zlotys) each. The total value of the second-prize awards is PLN 45,000 (in words: forty-five thousand zlotys).

 

2. The Grand Prize consists of a 6-day, 4-night trip to Tennessee for the Grand Prize winner and one accompanying person. The planned dates of the trip are 31 March - 5 April 2027. However, the Organiser reserves the right to change the dates of the trip for reasons beyond the Organiser’s control, in particular in the event of circumstances that prevent or hinder the trip from taking place on the originally planned dates. The Organiser will inform participants of any change to the dates in good time.  The Organizer will make the reservation and cover the costs of the prize as an agent for the winner and their companion, who agree to comply with all conditions imposed by third parties, including, without limitation, the relevant tour operator.

The winner and their companion must have a valid passport with at least six months’ validity; otherwise, they cannot require an earlier visa to travel to the USA. The winner and their guest must have a valid passport and a US visa or travel authorization (ESTA), unless they are Green Card holders. The winner and their guest must meet the immigration requirements (and Covid-19 requirements) for entry into the United States. All administrative matters related to the trip are the responsibility of the winner and their guest. Any additional expenses, including extra costs, travel to and from the departure airport, and insurance, are the responsibility of the winner.

The Organizer reserves the right to select an alternative winner if the original winner and their companion fail to verify their identity, age, ability to undertake the trip on the specified dates, and compliance with US immigration requirements by 24.02.2027. The specified date is the deadline for providing the Organiser with the information and documents necessary for the Prize to be awarded within the timeframes set out in the Rules.

 

3. Each Participant may win only one Prize of a given type in the Contest.

 

4. Committee appointed by the Organizer (hereinafter referred to as the “Contest Committee”). The Contest Committee will consist of three persons chosen by the Organizer.

 

5. Laureates are not entitled to request the cash equivalent of a prize or to exchange it for another prize.

 

6. The winner of the prize referred to in §3, section 1(a) will be informed by 18.01.2027.

 

§ 4

Rules of awarding Prizes in the Contest

 

1. From among all Contest Entries, the Contest Committee appointed by the Organizer will select the most creative Contest Entries, which will be awarded with Prizes in this Contest, in accordance with the rules described in § 2 of the Regulations. In selecting the Winners, the Contest Committee will be guided by its own discretion, taking into account originality and creativity in the execution of the Contest Task.

 

2. The winners of the prizes will be selected after the Contest has ended from among all entries received by the Contest closing date.

 

3. The winners of the Contest will be notified of their win via the email address provided during registration by 23:59 on 18 January 2026.

 

4. Minutes will be taken of the work of the Contest Committee.

 

5. The Organiser will award the winners who receive the Prizes an additional cash prize to cover the income tax payable on the Prizes. The amount of the additional cash prize is 11.11 per cent of the value of the Prize, with the amount of the additional cash prize being rounded to the nearest whole zloty in such a way that any fraction less than 50 groszy is disregarded, whilst any fraction equal to or greater than 50 groszy is rounded up to the nearest whole zloty. The additional cash prize will not be paid to the Winners, but will be used to cover the taxes referred to in the preceding sentence.

 

6. The Organizer, as the payer of the lump-sum personal income tax, will calculate, collect and remit to the appropriate Tax Office the lump-sum income tax due for the Prize won, before releasing the Prize to the Prize winner. The Prize winner is obliged to provide the Organizer with all data necessary to fulfill the aforementioned obligations.

 

7. The Organizer shall not be liable in the event that the Prize Winner is unable to notify the Prize Winner of the prize due to the Participant providing an incorrect e-mail address or changing e-mail address during the Contest.

 

§ 5

Rules of awarding Prizes in the Contest

 

1. The Organizer will inform the winners about the fact of winning and how the prize will be issued, via e-mail, to the address indicated during registration.

 

2. In the message mentioned above, the Organizer will request the Laureates to provide the data necessary for issuing the prize, such as:

1. The Participant's name and telephone number for contacting the Participant;

2. the address to which the Prize is to be sent (if different from the address of residence);

3. data required by tax law for tax reporting purposes related to the execution of the Contest, in particular residence address, PESEL, competent tax office.

 

3. The Winner shall provide the information referred to in Section 2 within 3 days of receiving the Organizer's notification. Failure to provide the information referred to in Section 2 within the period specified in the preceding sentence shall result in the Participant forfeiting the right to the Prize.

4. If the Winner cannot be notified of the Prize, fails to contact the Organizer within the specified period, fails to provide the required information within 3 days of being notified of winning the Prize, or provides false or inaccurate information, the Prize shall not be awarded and the Winner shall forfeit the right to the Prize. In such a case, the Organizer shall, by repeating the winner notification procedure, contact the Participant who achieved the next highest ranking in the Contest or decide not to award the Prize.

5. Prizes (excluding the Grand Prize) will be sent by courier by the Organizer to the address indicated by the Participant in the message referred to in paragraph 3 above within 30 days from the date on which the Winner provides the information required for the Award to be presented.

 

6. The Organizer does not provide for informing Participants who have not become winners about their individual results in the Contest.

 

7. The Organizer is the entity issuing the Prizes in the Contest.

 

8. Winners of the Grand Prize and their accompanying persons may be asked to consent to the free use of their image, for the purpose of creating footage of the trip, which the Organizer will use for promotional purposes. The consent is voluntary and is not a condition for receiving the prize.

 

 

§ 6

Complaint procedure

 

1. Complaints regarding the Contest should be submitted in writing to the postal address: Chromatique Julian Pęksa, 26 Szamotulska St., 60-366 Poznań with the annotation "compalint" or via e-mail, at the following address [email protected]

 

2. Complaints may be submitted until 25 January 2027. They will be resolved within 14 days of the date on which the Contest Commission appointed by the Organizer. The decision of the Contest Committee as to the submitted complaint is final. The Competition Commission's decision cannot be appealed to other bodies of the Organizer.

 

3. Complaints may be filed during the Contest period and no later than 7 days after Contest results. After this deadline, complaints will not be considered.

 

4. A properly submitted complaint should include: name, surname, exact address of the Participant and reasons for the complaint.

 

5. The Participant will be notified of the outcome of the complaint in writing or by email, depending on how the Participant submitted the complaint.

 

§ 7

Personal Information

 

1. Personal data shall be processed exclusively for the purposes of conducting the Contest, including in particular the administration of the process of selecting the winners and the distribution of prizes. 

 

2. Participants acknowledge that Brown-Forman Corporation (“BROWN-FORMAN”), the parent company of the Founder, as well as other companies forming part of the BROWN-FORMAN group (details available upon request), or employees, agents, partners, or licensees of BROWN-FORMAN, shall process their personal data in accordance with the BROWN-FORMAN Privacy Policy available at https://legal.brown-forman.com/privacy-policy/polish, to the extent necessary for the proper conduct of the Contest. The personal data of participants may be transferred to any country in which BROWN-FORMAN group companies or our service providers maintain facilities, and such personal data shall be stored to the extent permitted by applicable law. Should participants, at any point in the future, wish to be removed from the database, or should they wish to rectify their data or amend the manner in which they receive communications from us, they are kindly requested to write to the following address: [email protected]

 

§ 8

Provision of services by electronic means

 

1. As part of the Contest, the Organizer shall provide free of charge to the Participants, under the terms and conditions described in these Regulations, services by electronic means to the extent necessary for the execution of the Contest.

 

2. Services provided electronically for the purposes of the Contest shall be understood as such services as:

1. making the Regulations available;

2. making it possible to get acquainted with the Contest Task;

3. enabling participation in the Contest.

 

3. The agreement for the provision of services by electronic means is concluded when the Participant begins to use the services covered by the Regulations.

 

4. The Agreement for the provision of services by electronic means may be terminated by the Participant at any time by resigning from the Contest.

 

5. The technical condition necessary to use the services provided by electronic means is to have an installed web browser, e.g. Microsoft Edge, Mozilla Firefox, Opera, Chrome, Safari

 

6. The Organizer stipulates that the use of the services covered by the Regulations may involve standard risks associated with the use of the Internet and recommends that Participants, take appropriate steps to minimize them.

 

7. The Organizer uses its own system security and permanent IT support to ensure the security of transmitted and received data.

 

8. The provisions of § 6 of the Rules and Regulations apply accordingly to complaints about services provided electronically, with the time limit for filing a complaint counting from the moment of occurrence of an event justifying the filing of a complaint.

 

9. Matters not regulated by these Regulations with respect to the provision of services by electronic means shall be governed by generally applicable legal regulations, including in particular the Act of July 18, 2002 on the provision of services by electronic means (i.e. Journal of Laws of 2020, item 344).

 

10. These Regulations of the Contest are available to the Participants at the Organizer's office and on the website

§ 9

Final Provisions

 

1. The provisions of these Regulations shall be governed by the laws of Poland. Matters not regulated by these Regulations shall be governed by generally applicable laws, and in particular by the provisions of the Civil Code.

 

2. The Organizer reserves the right to change the provisions of these Regulations, if it is justified by the goal of the Contest and will not affect the conditions of participation in the Contest.

 

3. The rules of the Contest are determined solely by these Regulations.

 

4. The Organizer and the Founder shall not be liable for any injury, death, damage or costs incurred by the Participant in connection with participation in the Contest. From the moment the Prize is handed over, the liability for any and all events, including damages resulting from fortuitous events, force majeure, or improper use of the Prize, shall rest with the carrier, travel agency, other entity executing the Prize, and the Winner himself, except for liability that cannot be excluded or limited under applicable law.
