(NON-PURCHASE RELATED) (the “Promotion”)

1.      The Promoter: Edward Dillon & Co. Ltd., registered office Block P7, with its business residing in Eastpoint Business Park, East Point Business Park, Alfie Byrne Rd, East Wall, Dublin 3.

2.      By entering the Promotion, entrants confirm that they have read and agree to be bound by these Terms and Conditions and by any reasonable decisions made by  the Promoter.

3.      Eligibility: The Promotion is open to Republic of Ireland residents only aged 18 years or over, excluding employees and the immediate families of Edward Dillon Ltd, their affiliates or agents and any other person who is professionally associated with this promotion.

4.      The promotion will be in the following stores on the following dates and times (the “Promotion Period”):

5.      Failure to adhere to these Terms and Conditions may result in the entrant being unable to participate in the Promotion or being unable to receive any subsequent promotional material associated with the Promotion. 

6.      No purchase necessary.

7.      The Promotion is limited to a maximum of one entry per person, such entry being based on the Promotion mechanism as described in Clause 8 (below) of these Terms and Conditions and subject to acceptance by the Promoter of the entrant to this participate in this Promotion (with such acceptance not being unreasonably withheld)

8.      Promotion Mechanism: To enter the Promotion, participants must select an apple from the tree. Of the apples attached to the tree some, but not all,  will contain prize cards. A prize card could entitle an entrant to win either a Jack Daniels t-shirt, bottle opener, keyring, 1 or 20 €10 Store Voucher, 1 or 4 €150 restaurant vouchers or a bucket BBQ. An entrant is in no way guaranteed a prize card when they participate in the Promotion.

9.      For each of the aforementioned stores listed in Clause 4 above, the following prizes are available at a maximum rate of one item per entrant, subject to availability: 20 x Jack Daniels keyrings, 15 x Jack Daniels Bottle Openers, 14 x Jack Daniels T-shirts and 1 x Jack Daniels branded bucket BBQ.

10.  If any one type of prize becomes unavailable the next closest prize in value will be given.  The player will be notified in advance if any of the prizes have run out.

11.  The Promotion will stop at the allocated time specified in Clause 4 above, however, sampling will continue even when all prizes have been awarded. Any potential new entrants shall be notified before participating in any sampling that the Promotion Mechanism described in Clause 8 above, has ended.

12.  Any prizes not won within the Promotional Period in each store will roll over into the next store. Any prizes remaining at the end of the Promotion will be withdrawn.

13.  No cash or other alternative to a prize will be offered, save for in the event of unforeseen circumstances, in which the Promoter reserves the right to offer an alternative reward of equal or greater value than the original.

14.  The Promoter’s decision will be final and no correspondence will be entered into.

15.  The Promoter reserves the right to exclude any entries, which it believes to be fraudulent or based on misconduct or where it reasonably believes that an individual is under the age of 18 or that individual has been unable to verify their age as being over the age of 18  when asked to do so.

16.  The Promoter reserves the right to vary the Terms and Conditions or to terminate or cancel the Promotion and/or any potential promotional material associated with the Promotion any time without notice. No correspondence will be entered into in relation to any dispute arising out of the Promotion or its termination or cancellation.

17.  The Promoter will not be liable to any entrant for any failure, cancellation or other discontinuance or delay affecting the Promotion or any promotional material offered during the course of the Promotion.

18.  The Promoter does not accept any liability for loss or damages incurred, or responsibility for any claim, except for those liabilities that are unable to be limited by law, as a result of acceptance of the Prize.

19.  These Terms and Conditions are governed by and construed in accordance with the laws of Ireland and subject to the exclusive jurisdiction of the Irish Courts.
